ORDINANCE NO. 2872
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
APPROVING THE PLANS AND SPECIFICATIONS OF BUSCH - HUTCHISON
& ASSOCIATES, INC. FOR THE PARK STREET IMPROVEMENT
PROJECT; AWARDING THE CONTRACT FOR SAID PROJECT TO
MARATHON PAVING AND UTILITY CONSTRUCTORS, INC. FOR FIVE
HUNDRED THIRTY -FIVE THOUSAND FIVE HUNDRED THIRTY -TWO
AND 50/100 ($535,532.50) DOLLARS; DIRECTING THAT NO
WORK BE STARTED ON SAID PROJECT UNTIL COMPLETION OF THE
ASSESSMENT PROCEEDINGS; MAKING OTHER PROVISIONS RELATED
THERETO; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, by Ordinance No. 2756 Council did determine
the necessity for and ordered the permanent improvement of
Park Street; and
WHEREAS, a part of the costs of this improvement are
proposed to be assessed against the property and owners of
property abutting the Park Street Improvement Project; and
WHEREAS, the City Council did authorize advertising for
bids for the Park Street Improvement Project to be received
April 1, 1980; and
WHEREAS, notice to bidders as to the time and place,
when and where the contract would be let was published
pursuant to provisions of Section 74 of the Charter of the
City of Baytown; and
WHEREAS, all bids were opened and publicly read at City
Hall at 10:00 a.m., Tuesday, April 1, 1980, as per published
notice to bidders; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: That the City Council of the City of Baytown
hereby accepts the bid of Marathon Paving and Utility Constructors,
Inc. for the sum of Five Hundred Thirty -Five Thousand Five
Hundred Thirty -Two and 50/100 ($535,532.50) Dollars, and the
Mayor and City Clerk of the City are hereby authorized and
directed to execute and attest to a contract with Marathon
Paving and Utility Constructors, Inc. for the Park Street
Improvement Project, containing the plans, specifications,

and requirements of the Consulting Engineers and appropriate
bond and drawn provisions in accordance with the provisions
of TEX.REV.CIV.STAT. art. 5160.
Section 2: That no work shall be started on this
project until completion of the assessment proceedings.
Section 3: That pursuant to the provisions of TEX.REV.
CIV.STAT. art. 2368a, the City Manager is hereby granted
general authority to approve any change order involving a
decrease or an increase in costs of Five Thousand and No /100
($5,000.00) Dollars or less, provided that the original
contract price may not be increased by more than ten (10 %)
percent or decreased by more than twenty -five (25 %) percent
without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect from and
after its passage.
INTRODUCED, READ, and PASSED by the affirmative vote of
the City Council on this the 10th day of April , 1980.
