ORDINANCE NO. 2868
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, PROVIDING FOR THE ABANDONMENT, USE, AND DISPOSITION
OF CITY REAL PROPERTY; MAKING VARIOUS PROVISIONS RELATED
THERETO; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: That Chapter 26 of the Code of Ordinances
of the City of Baytown, Texas, is hereby amended by the
addition of a new Article IV, Abandonment, Sale and Disposition
of City Rights -of -Way and Properties, that shall read as
follows:
(See Exhibit "A" attached)
Section 2: That Chapter 26 of the Code of Ordinances
of the City of Baytown, Texas, is hereby amended by the
addition of a new Article V, Buildings on Utility Easements,
that shall read as follows:
(See Exhibit "B" attached)
Section 3: This ordinance shall take effect from and
after its passage.

Article IV. Abandonment, Sale and Disposition of
City Rights -of -Way and Properties.
Sec. 26 -50. Abandonment of streets and alleys.
(a) All persons desiring to have the city exercise its
powers regarding and abandoning, altering, closing, and
vacating streets, alleys, and other public ways and portions
thereof, shall file their petition with the city clerk, in
writing, directed to the city council. Such petition shall
contain a description of the street, alley, or portion
thereof, as the case may be, and attached to said request
shall be a list of all owners abutting said street, alley,
or portion thereof, as the case may be, together with the
last known address of all such owners. In the event that
all abutting property owners do not join in said petition, a
statement shall be attached to said request showing the
reason for non - participation of those who have not signed.
The city clerk shall make the city tax rolls available to
any petitioner under this ordinance for the purpose of
determining the names and addresses of all abutting property
owners and the tax rolls shall be conclusive as to the names
of the abutting property owners for the purposes of this
ordinance.
(b) Upon the filing of such request and fee as provided in
Sections 1 and 2, the city clerk shall mail notices of said
request and release forms by certified mail, return receipt
requested, to all abutting property owners.
(c) In the event the petition requests that only a portion
of a through street, alley, or public way which is open to
public access from either direction is to be abandoned,
altered, closed, or vacated, then it shall be necessary for
the petitioner to provide the city clerk with the names and
last known mailing addresses of all abutting property owners
both for the portion to be closed and for that portion which
is to remain open in either direction up to the next inter-
section with another street, alley, or public way. Notices
and release forms will be mailed to all such abutting
property owners for the closed and open portions of said
street, alley, or public way as provided in Section 3,
above.
(d) The proposed action by the city council shall be
placed on the agenda for the next public meeting of the city
council after the filing of the petition or such public
meeting as the city council may set, provided that at least
ten (10) days have elapsed from the date said request is
filed until the date of said meeting in order to allow
sufficient time for the mailing of notices and release forms
to the abutting property owners.
(e) Streets or alleys, whether owned in fee or used by
easement, may be sold to the abutting owner or owners, in
proportion to the underlying fee ownership as exists, or
would exist if by easement. When ownership is of the under-
lying fee, the apportionment shall be determined by city
council, which determination will be final. Upon the payment
of (1) a fee of $100.00 or (2) the appraised market value of
the street or alley, based on not less than one appraisal,
whichever is greater, and after abandonment of street or
alley, the city will deliver a quitclaim deed to the owners
of the fee simple title thereto or abutting owners. The
determination of market value of any street or alley as
fixed by city council shall be final.

(f) This section shall not be construed to give any person
the vested right to compel the city to abandon or vacate a
street or alley.
Sec. 26 -51. Abandonment of easement.
(a) Upon the payment of (1) a fee of $100.00, or (2) the
appraised market value of the easement, based on not less
than one appraisal, whichever is greater, and after abandon-
ment of the easement, the city will deliver a quitclaim deed
to the owners of the fee simple title thereto. The deter-
mination of market value of any easement as fixed by city
council shall be final.
(b) This section shall not be construed to give any person
the vested right to abandon or dispose of any easement.
Sec. 26 -52. Sale or rental of city land generally.
(a) Any land owned by the city, other than land provided
for in Sections 26 -50, 26 -51, and 26 -53, determined not to
be needed for city purposes, shall be advertised and may be
sold, rented, or leased to the highest bidder upon authori-
zation of city council, provided, however, that the selling
price shall never be for less than the market value of such
land as determined by city council.
(b) The city council retains the right to reject any and
all bids.

Article V. Buildings on Utility Easements.
Sec. 26 -60. Definitions.
(a) Actual notice, as used in this article, means actual
knowledge or such circumstances or conditions as would put a
person of ordinary prudence on inquiry to determine the
facts.
(b) Constructive notice, as used
such information or facts as may be

Sec. 26 -61. Permit to construct --- Required.
It shall be unlawful for any person to build, erect, or
construct, or cause to be built, erected, or constructed,
any building, structure, or edifice for any use or occupancy
whatsoever in, upon, over, or across any easement, or any
part thereof, granted to the city for sanitary sewer, storm
sewer, water main, or electric line conduit purposes, or a
combination of same, or upon, over, or across any privately
constructed sanitary sewer, storm sewer, water main, or
electric line conduit managed, supervised, or controlled by
the city or connected with the sanitary sewer system, storm
sewer system, water main system, or electric line conduit
system of the city when such person has actual or constructive
notice of such privately constructed sewers, mains, or
conduits, without first procuring a written permit to do so
from the director.
Sec. 26 -62. Same -- Application.
Application for a permit required shall be addressed in
writing to the director, and the applicant shall set forth
therein the true name and address of the person seeking the
permit; the name and address of the contractor employed to
do the work, if any; the nature of the building, structure,
or edifice proposed to be erected, including the type of
construction proposed; the use or occupancy to which such
proposed building is to be put; the name of the subdivision,
if any, and the lot and block number where it is proposed to
be built, and whether or not such proposed building, structure,
or edifice, or any part thereof, will be in, upon, over, or
across any easement granted to the city, or upon, over, or
across any privately constructed sanitary sewer, storm
sewer, water main, or electric line conduit of which applicant
has actual or constructive notice.
Sec. 26 -63. Same -- Appeal from refusal.
If the director refuses to grant a permit applied for, the
applicant may have such action reviewed by an appeal to the
city council, in writing within ten (10) days after the
decision of the director is published. The hearing on
appeal to the council shall be de novo and the decision of
the council shall be final.

Sec. 26 -64. Permit to maintain when constructed permit not
obtained.
Should it be made to appear to the director, upon written
application by any person, that a building, structure, or
other edifice has been constructed upon or across any sanitary
sewer, storm sewer, water main, or easement granted for the
purpose of constructing and maintaining such utilities, and
that such construction was done without the required permit
through inadvertence, mistake, or ignorance of the existence
of the sewer, water line, or easement in question, the
director is empowered to issue a permit to maintain such
building, structure, or edifice provided that, upon investi-
gation, the director is satisfied that a permit would have
been granted in the initial instance prior to construction.
Should the director refuse to issue the permit to maintain
as herein provided, the applicant shall have the same right
to appeal to the city council as provided in section 26 -63.
Sec. 26 -65. Assumption of risks by builder.
Any person who builds, erects, or constructs a building,
structure, or edifice over any of the sewers, mains, or
lines assumes all of the risks incident to such construction,
and the city shall never be liable for any damage occasioned
to any such building, structure, or edifice by reason of the
granting of permission to build or construct the same, or
because of the supervision, operation, and maintenance of
any sanitary sewer, storm sewer, water main, or electric
line conduit, whether the same is in an easement granted to
the city for that purpose or privately constructed.
Sec. 26 -66. Tunneling beneath or excavating through floor or
foundation to inspect or repair utility installa-
tions.
If, in the course of maintenance and supervision of any of
the sewers, mains, or conduits over which a building, structure,
or edifice has been built or erected, it should or may
become necessary to tunnel beneath or excavate through the
floor or foundation of such building, structure, or edifice
for the purpose of making inspections or repairs, the person
owning such building, structure, or edifice, his successors
or assigns, shall stand and bear all of the expense and
damage occasioned to such building, structure, or edifice by
reason of such tunneling or excavation. In addition thereto,
such person shall likewise stand and bear the added cost
incurred by the city in tunneling beneath or excavating
through the floor or foundation of such building, structure,
or edifice for the purpose of making such inspections or
repairs, the amount of which added cost is to be determined
by the director, and such amount shall be paid promptly to
the city.

PROGRAM NARRATIVE
The Baytown Senior Citizen Taxi Service Program will
enroll up to 540 senior citizens and will operate a trans-
portation service during the twelve (12) months from January
1, 1980 through December 31, 1980. Eligible.participants
must be residents of Baytown, and must be over the age of
60. Income guidelines will be used to determine what
ategories
portion of the taxi fare the City will pay. Fare
include free and half -fare rides. Transportation service
will be purchased from the local taxicab companies. Riders
will call the cab companies to request service. The cab
companies will pick up riders and take them to any place
within the city limits. Riders will be eligible for eight
one -way rides per month. The fares will be based on fares
set by city ordinance. The current rate is $1.15 for pickup
