Ordinance No. 2,86200327 ---5 ORDINANCE NO. 2862 AN ORDINANCE AWARDING THE CONTRACT FOR THE 1980 STREET IMPROVEMENT PROGRAM TO BROWN & ROOT, INC.; MAKING CERTAIN FINDINGS AND PROVISIONS RELATED TO THE SUBJECT. WHEREAS, the City Council of the City of Baytown did authorize the City Engineer of the City of Baytown to advertise for bids for the construction of the 1980 Street Improvement Program to be received March 24, 1980; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of TEX.REV.CIV.STAT., art. 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 10:00 o'clock a.m., Monday, March 24, 1980, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section l: That the City Council of the City of Baytown hereby accepts the bid of Brown & Root, Inc., according to the plans and specifications set forth by the City Engineer on a construction timetable of 110 working days for the sum of Three Hundred Eighty -Five Thousand Eight Hundred Three and 60/100 ($385,803.60) Dollars, and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Brown & Root, Inc. for the construction of the following streets under the 1980 Street Improvement Program: Bayway Drive, Bay Villa, Chesapeake, Colorado, Foster, Lobit, Missouri, Narcille, Rice, Sandy, Strickland, Windy, Woods, and asphalt overlays on Ashbel, Gaillard, Jones, and Market Street; containing the plans, specifications, and requirements of the City Engineer and appropriate bond and drawn provisions in accordance with the provisions of TEX.REV.CIV.STAT. art. 5160. O0327 -5a Section 2: That, pursuant to the provisions of TEX.REV. CIV.STAT., art. 2368a, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, subject to the proviso that the original contract price may not be increased by more than twenty -five (25°0) percent or decreased by more than twenty - five (250) percent without the consent of the contractor to such decrease.
