Ordinance No. 2,802`0110 -1 ORDINANCE NO. 2802 AN ORDINANCE AMENDING CHAPTER 3, "AIRCRAFT AND AIRPORTS," OF THE CODE OF ORDINANCES TO ALLOW USE OF HELICOPTERS AT PLACES WITHIN THE CITY OF BAYTOWN OTHER THAN ESTAB- LISHED LANDING FIELDS OR AIRPORTS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That Chapter 3 of the Code of Ordinances of the City of Baytown is hereby amended by the repeal of Section 3 -1, Definitions, as presently constituted and by the adoption of a new Section 3 -1 that shall read as follows: Sec. 3 -1. Definitions. (a) Aircraft. Any aeroplane, airplane, gas bag, balloon, or any contrivance now known or hereafter invented, used or designed for navigation or flight in the air, except a helicopter or other vehicle whose support is the air is normally derived from the verticle component of force produced by airfoils mechanically rotated about an approx- imately verticle axis. (b) Acrobatic flying. The performance of tailspins, loops, rolls, or any intentional or unnecessary maneuver involving an abrupt change in the altitude of an aircraft or performing stunt flying. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, sub- section, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the valid- 00110 -1a ity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect from and after its passage.
