ORDINANCE NO. 2782
AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER
OF THE CITY OF BAYTOWN TO EXECUTE A CONTRACT WITH THE
RETIRED SENIOR VOLUNTEER PROGRAM FOR THE REGISTRATION,
RECRUITMENT, AND COORDINATION OF SENIOR VOLUNTEER
COMMUNITY SERVICE; AUTHORIZING PAYMENT BY THE CITY OF
THREE THOUSAND ONE HUNDRED EIGHTY -SIX AND N01100
($3,186.00) DOLLARS WITH REGARD TO SUCH AGREEMENT; AND
PROVIDING FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

Section l: That the City Council of the City of Baytown,
Texas, hereby authorizes and directs the City Manager to
execute a contract with the Retired Senior Volunteer Program
for the payment by the City of Baytown of the sum of Three
Thousand One Hundred Eighty -Six and No /100 ($3,186.00)
Dollars for the registration, recruitment, and coordination
of senior volunteer community service. A copy of said
agreement is attached hereto, marked Exhibit "A," and made a
part hereof for all intents and purposes.
Section 2: That this ordinance shall take effect from
and after its passage.
INTRODUCED, READ, and PASSED by the affirmative vote of
the City Council of the City of Baytown this 13th day of
December 1979.

AGREEMENT
COUNTY OF HARRIS
. THIS AGREEMENT, made.and` "entered into by and between
the CITY OF BAYTOWN, a municipal corporation,.hereinafter
called "City," and the Retired Senior Volunteer Program,.
hereinafter called the "Program Applicant."
WITNESSETH:
WHEREAS, the Retired Senior Volunteer Program has been
organized to strengthen and supplement efforts to meet a
broad range of human, social, and environmental needs by
encouraging and enabling constructive volunteer service in
agencies, institutions and situations where the application
of human talent and dedication may help to meet.such ends;
.and
WHEREAS, the City Council of the City of Baytown has
determined it is.in the public interest that such a program
to help retired persons avail themselves of opportunities
for volunteer service in the community is in the public
interest; NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS:
That.in consideration of the mutual convenants, agree-

ments, and benefits to both parties, it is agreed as follows:
I.
The Program Applicant, as independent contractor,
agrees to register.non- profit and public agencies and
institutions in the City of Baytown that are in need of
volunteers, to recruit men and.women over sixty to act as
volunteers, to support and publicize these senior volunteers..
and to do all other acts necessary for the successful
operation of this civic enterprise.
II.
This agreement is to cover services to be rendered from
January 1, 1980, to December 31, 1980.

The City agrees to pay to Retired Senior Volunteer
Program the sum of Three Thousand One Hundred Eighty -Six and
No /100 ($3,186.00) Dollars for service to be rendered in the
development, organization, supervision, and management of
this program. The City agrees to pay the Program Applicant
in advance in equal quarterly payments of Seven Hundred
Ninety -Six and 50/100 ($796.50) Dollars. In no event will
the City pay more than Three Thousand One Hundred Eighty -Six.
and No /100 ($3,186.00) Dollars to the Program Applicant.
IV.
In performance of the services.agreed` to, herein, the
Program Applicant agrees.to observe and strictly comply.
with, all the terms, conditions, rules, and regulations of
all applicable federal,,state, and city statutes.
V.
It is expressly agreed and understood by all parties
hereto that the Program Applicant is an independent contractor
in its relationship to the City of Baytown. Nothing herein
contained at any time or in any manner shall be construed to
effect an agreement.of partnership or joining venture or
render any party hereto the employer or master of any other
party and /or its employees agents or representatives.
VI.
The Program Applicant agrees to indemnify_, and does
hereby indemnify, hold harmless and defend, the City of
Baytown, its agents, servants, or employees, from and
against any and all claims for damages or injuries to persons
or property, whether real or asserted, arising out of or
incident to the operation of this program.
