Ordinance No. 2,75891108-0 0 ORDINANCE NO. 2758 AN ORDINANCE ACCEPTING THE BID OF BANDA, CONDON & HUDSON, INC. FOR THE ENLARGEMENT OF STORM SEWER BOX INLETS AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF ONE HUNDRED ONE THOUSAND SIX HUNDRED AND N01100 ($101,600.00) DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS, the City Council of the City of Baytown did authorize the City Engineer to advertise for bids for the enlargement of storm sewer box inlets to be received October 291 1979; and WHEREAS, notice to bidders as to the time and place, ® when and where the contract for said construction would be let was published pursuant to provisions of TEX.REV.CIV.STAT. art. 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 10:00 a.m., Monday, October 29, 1979, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown hereby accepts the bid of Banda, Condon & Hudson, Inc. 41 according to the plans and specifications set forth by the City Engineer for the sum of One Hundred One Thousand Six Hundred and No /100 ($101,600.00) Dollars, and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Banda, Condon & Hudson, Inc. for the enlargement of storm sewer box inlets containing the plans, specifications, and requirements of the City Engineer and appropriate bond and drawn provisions in accordance with the provisions of TEX.REV.CIV.STAT. art. 5160. 0 91108 Section 2: That pursuant to the provisions of TEX.REV.CIV._ ® STAT. art. 2368a, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, subject to the proviso that the original contract price may not be increased by more than twenty -five I (25,0) percent or decreased by more than twenty-five (25%) ,o) percent without the consent of the contractor to such decrease.
