Ordinance No. 2,752NE I E El O c.6 pr 1 01 -7 ,1 epi i , 15 - 9 ORDINANCE NO. 2752 91024 AN ORDINANCE AMENDING CHAPTER 18, "MOTOR VEHICLES AND TRAFFIC," OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN BY THE AMENDMENT OF SECTION 18 -54, REMOVAL OF TRAFFIC HAZARDS; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown is hereby amended by the repeal of Chapter 18, "Motor Vehicles and Traffic," Section 18 -54, as presently constituted and by substituting in its place a new Section 18 -54 which shall read as follows: Sec. 18 -54. Removal of traffic hazards. Any police officer who .shall find a vehicle, boat, structure, object, substance, or material stopped or resting upon a public street or public traffic area which in the opinion of the officer poses a particular hazard to the movement of traffic because of its proximity to or position upon a roadway, the lighting or weather conditions, its visibility or the density of traffic, or the nature of the traffic movement around or across such hazard, is authorized to remove or cause the same to be removed. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, sub- section, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the valid- ity of the remaining provisions of'this ordinance or their 9102 4a s application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable.
