Ordinance No. 2,738® ORDINANCE NO. 2738 AN ORDINANCE AMENDING CHAPTER 31, "UTILITIES," OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN BY AMENDING SECTION 31 -54, WATER DEPOSITS AND REFUNDS; AMENDING SECTION 31 -55, WATER TAPPING FEES; AMENDING SECTION 31- 56, WATER RATES; ADDING A NEW SECTION 31 -61, SERVICE CHARGE FOR WATER TURN ON; AMENDING SECTION 31 -6.5, SEWER SERVICE CHARGE; AMENDING SECTION 31 -67, SEWER TAPPING FEES; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the Code of Ordinances of the City of ® Baytown, Texas is hereby amended by the amendment of Chapter 31, "Utilities," Article IV, Water Service, by the repeal of subsection 31- 54(b), Water Deposits and Refunds, Section 31- 55, Water Tapping Fees, and subsection 31- 56(a), Water Rates, as presently constituted and by substituting in their place a new subsection 31- 54(b), a new Section 31 -55, and a new subsection 31 -56(a) which shall read as follows: Sec. 31 -54. Water deposits and refunds. (b) Amount of deposits. (1) Residential consumers occupying single family dwelling houses shall be required to place on deposit the amount of $20.00. (2) Commercial water deposits shall be determined by the utility office manager. This deposit is to be generally comparable to two months water service of commercial businesses similar to the applicant. (3) Deposits for apartment houses, mobile parks or other multi - family dwelling projects shall be determined by the Utility Office Manager, but shall not be less than $20.00 per unit. Sec. .31 -55. Water tapping fees. Sec. 31 -56. Water rates. (a) Basic rate schedule. Except as hereinafter provided, each residential and commercial user of water situated within the corporate limits of the City of Baytown and supplied with water service by the City of Baytown shall be charged a monthly water. service charge based upon the amount of water consumption attributed to the user, as determined herein, and applied to the following rate schedule: Gallons of water used.per month Amount or rate to be charged First 2,000 $3.50 (Minimum Mon.th.ly rate) Next 3,000 $0.75 per 1,000 gallons Next 10,000 $0.70 per 1,000 gallons All over.15,000 $0.65 per 1,000 gallons Any user or.customer who.does not pay the amount due by the due date indicated on his statement shall be charged a penalty, as hereinafter provided. Section 2: That the Code of Ordinances of the City of Baytown is hereby amended by the amendment of Chapter 31, "Utilities," Article IV, Water Service, by the addition of a new Section 31 -61, Service Charge for Water Turn On, which shall read as follows: Sec. 31 -61. Service charge for water turn on. If the City turns on a customer's water service at the request of the customer, he will be charged a service charge of $5.00. When a reconnection charge under Section 31 -59 of this article is applicable, this section shall not apply. . Section 3: That the Code of Ordinances of the City of Baytown is hereby amended by the amendment of Chapter 31, "Utilities," Article V, Sewer Service, by the repeal of Section 31 -65, Sewer Service Charge, and by the repeal of subsection 31- 67(a), Sewer Tapping Fees, as presently constituted, and by the addition.of a new Section 31 -65 and a new subsection 31 -67(a) which shall read as follows: Sec. 31 -65. Sewer service charge. A. Residential dwelling units. (1) Individually metered for water consumption: Each residential dwelling unit individually metered and -2- 0 9096 9b billed for the consumption of water-shall be charged ® for and owe each month a sewer service charge based upon the consumption of water attributed to it as determined by the provisions of this Code relating to water charges, applied to the following rates: Gallons of water Sewer service rate used per month to be charged First 3,000 gallons $3.50 (minimum monthly rate) Thereafter $0.40 per 1,000 gallons (2) Jointly metered for water consumption: Multi- family dwelling unit projects not individually metered for water shall be charged for and owe each month a sanitary sewer charge based upon/consumption of water attributed to it as determined by the provisions of the Code relating to water charges applied to the following rates: Gallons of water used for month First 3,000 gallons times the number of occupied units Excess of 3,000 gallons times the number of occupied units Sewer service rate to be charged $3.50 (minimum monthly rate) times the number of occupied units $0.40 per 1,000 gallons (a) Occupied units in the project shall be taken to be the total number of units in the project unless the project manager shall report to the city on the form provided in Annex "A" the actual number of occupied units as of the first day of the current month. This report must be received by the city no later than the 10th day of the current month. B. Commercial units. Each commercial unit.shall be charged for and owe each month a sanitary sewer service charge based upon the consumption of water attributed to it, applied to the following rate schedule: Gallons of water Sewer service rate used per month to be charged First 3,000 gallons Thereafter C. Mobile home parks. $3.50 (minimum monthly rate) $0.40 per 1,000 gallons Mobile home parks shall be charged for and owe each a sanitary. sewer service charge based upon consumption of water attributed to it as determined.by the provisions of this Code relating to water charges applied to the following rates: Gallons of water used per month First 3,000 gallons times the number of occupied spaces Excess of 3,000 gallons times the number of occupied spaces 5911 Sewer service rate to be charged $3.50 (minimum monthly rate) times the number of occupied spaces $0.40 per 1,000 gallons 0 9099c (a) Occupied spaces in the project shall be taken to be the total number of spaces in the project, unless the project manager shall report to the city on the form provided in Annex "A" the actual number of occupied spaces. Box 424 Baytown, Texas 77520 Dear Sir: I hereby certify that I am the owner (or manager) of a multi- family dwelling project located at Street, Baytown, Texas. This project is known as the (indicate the project's name, if applicable). I hereby certify that the aforementioned project has (number,) units. I further certify that as of the first day of the current calendar.month, there were (number) occupied units in the project, and that there were (number) unoccupied units. I understand that the information hereby given is to be used by the City of Baytown in computing the current month's sewer service charge for this project. I also understand that this information must be received by the City of Baytown no later than the 10th day of each month in order to be considered. I further understand that the information hereby given may be verified at any time upon the request of the Utility Office Manager of the City of Baytown. (Signature) Manager or Owner Sec. 31 -67. Sewer tapping fees. ® (a) The water billing department shall assess and collect a one - hundred forty dollar ($140.00) sewer tap fee for each and every 4 -inch sewer tap. All other types (6 inches and larger.) and other special connections shall be made at estimated actual cost as determined by the Utility Office Manager with consultation of the Director of Public Works or his designee. Section 4: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ® ordinance. 909 9d ® Section 5: If any provision, section, exception, sub- section, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the'valid- ity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 6: This ordinance shall take effect from and after ten (10) days from its passage by the City Council, except for the provisions of this ordinance relating to water service charges (Sec. 31 -56 as amended herein) and sewer service charges (Sec. 31 -65 as amended herein) which shall become effective with billings showing service for the month of October, 1979. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
