Ordinance No. 2,731L� cf 90962 ORDINANCE NO. 2731 d AN ORDINANCE AMENDING CHAPTER 22, "PEDDLERS AND SOLICITORS," OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN BY DEFINING CHARITABLE SOLICITOR; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; PROVIDING FOR A PENALTY OF UP TO $200.00; AND PROVIDING FOR THE PUBLI- CATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That Chapter 22, "Peddlers and Solicitors," of the Code of Ordinances of the City of Baytown is hereby amended by the repeal of Sec. 22 -21, Definitions, as presently constituted, and by the adoption of a new Sec. 22 -21 that shall read as follows: Sec. 22 -21. Definitions. A "charitable solicitor" is any person, group or organization intending to solicit funds for some charitable, scientific, religious or educational purpose, or the selling or taking orders or offering to sell or take orders for any goods, wares, merchandise, services, photographs or magazines with the representation that some or part of the solicited funds will remain available for charitable, scientific, religious or educational purposes. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby ® repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, sub- section, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the valid- ity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. 90922a Section 4: Any person who shall violate any provision ® or provisions of this ordinance shall be guilty of a misde- meanor and, upon conviction, shall be punished by a fine of not more than Two Hundred ($200.00) Dollars. Each day of the continuance of such violation shall be considered a separate offene. Section 5: This ordinance shall take effect from and after ten (10) days after its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice 0 within ten (10) days after its passage.
