ORDINANCE NO. 2715
AN ORDINANCE AMENDING CHAPTER 7, "BUILDINGS," OF THE
CODE OF ORDINANCES OF THE CITY OF BAYTOWN TO REQUIRE
BUILDING PERMIT FOR CONSTRUCTION OR ALTERATION OF
PARKING AREAS; REPEALING ORDINANCES INCONSISENT HERE-
WITH; CONTAINING.A SAVINGS CLAUSE; PROVIDING FOR A
PENALTY OF UP TO $200.00; AND PROVIDING FOR THE PUB-
LICATION AND EFFECTIVE DATE HEREOF.
WHEREAS, the Southern Building Code Congress has promulgated
a certain work known as the Standard Building Code, 1976
Edition; and
WHEREAS, the laws of the State of Texas provide that
such standards may be adopted by reference; and
WHEREAS, by Ordinance No. 2234, City Council has previously
adopted said building code with certain exceptions; NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
section 1: That Chapter >.7, "Buildings," of the Code of
Ordinances of the City of Baytown is hereby amended by the
addition to Section 7 -4.1 Building Code -- Adopted by Reference--
Amendments, a new exception that shall read as follows:
Subsection (a) Section 105.1, Application for Permit --
When Required, is hereby amended by the repeal of same as
presently constituted, and by the adoption of a new subsection
(a) that shall read as follows:
Section 105 -- Application for Permit.
105.1 - -When required.
Any owner, authorized agent, or contractor who desires to
construct, enlarge, alter, repair, move, demolish, or change
the occupancy of a building, structure, parking lot, or
parking area, or to erect, or construct a sign of any descrip-
tion, or to install or alter fire - extinguishing apparatus,
elevators, engines, or to install a steam boiler, furnace,
heater, incinerator, or other heat producing apparatus, or
other appurtenances, the installation of which is regulated
by this code, or to cause any such work to be done, shall
first make application to the Building Official and obtain
the required permit therefor.

to the extent of such inconsistency and in all other respects
this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter

Section 3: If any provision, section,
section, paragraph, sentence, clause or phr
ordinance or the application of same to any
circumstances, shall for any reason be held
covered by this
exception, sub-
ise of this
person or set of
unconstitutional,
void or invalid, such invalidity shall not affect the valid-
ity of the remaining provisions of this ordinance or their
application to other persons or sets of circumstances and to
this end all provisions of this ordinance are declared to be
severable.
Section 4: Any person who shall violate any provision
or provisions of this ordinance shall be guilty of a misde-
meanor and, upon conviction, shall be punished by a fine of
not more than Two Hundred.($200.00) Dollars. Each day of
the continuance of such violation shall be considered a
separate offence.
Section 5: This ordinance shall take effect from and
after ten (10) days after its passage by the City Council.
The City Clerk is hereby directed to give notice hereof by
causing the caption of this ordinance to be published in the
official newspaper of the City of Baytown at least twice
within ten (10) days after its passage.
INTRODUCED, READ, and PASSED by the affirmative vote of
the City Council of the City of Baytown, this the 23rd
day of August 1979.
