ORDINANCE_NO. 2709
AN ORDINANCE AMENDING CHAPTER 7, "BUILDINGS ", OF THE
CODE OF ORDINANCES BY THE ADDITION OF SECTION 7 -37,
BUFFER FENCING -- EXCEPTIONS, TO ESTABLISH EXCEPTIONS TO
THE REQUIREMENT FOR BUFFER FENCING; REPEALING CONFLICTING
ORDINANCES; CONTAINING A SAVINGS'CLAUSE; AND PROVIDING
FOR THE EFFECTIVE-DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: That the Code of Ordinances of the City of
Baytown is hereby amended by the addition to Chapter 7,
"Buildings ", Section 7 -37, Buffer Fencing -- Exceptions, which
® shall read as follows:
Sec. 7 -37. Buffer fencing -- exceptions.
Exceptions to the requirement for buffer fencing may be
granted by the chief building inspector when the building
permit is issued if:
(a) the building,permit is for the construction of a
building to be used as a church; and
(b) if the chief building inspector determines that a
buffer fence would serve no useful purpose.
Decisions of the chief building inspector may be appealed to
the city council by any affected party prior to the issuance
of a certificate of occupancy.
® Section 2: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby
repealed; provided, however, that such repeal shall be only
to the extent of such inconsistency and in all other respects
this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered by this
ordinance.,
Section 3: If any provision, section, exception, sub-
section, paragraph, sentence, clause or phrase of this
ordinance or the application of same to any person or set of
® circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the valid-
ity of the remaining provisions of this ordinance or their
application to other persons or sets of circumstances and to

this end all provisions of this ordinance are declared to be
severable.
Section 4: This ordinance shall take effect from and
after its passage.
