Ordinance No. 2,647ga ORDINANCE NO. 2647 0411 -1 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS; DETEMIINING AND FIXING THE SCHEDULES OF RATES TO BE CHARGED BY ENTEX, INC. IN THE CITY OF BAYTOWN, TEXAS, FOR NATURAL GAS AND NATURAL GAS SERVICE FURNISHED BY IT TO RESIDENTIAL AND COMMERCIAL CONSUMERS; FIXING THE EFFECTIVE DATES OF GAS RATES PRESCRIBED IN THIS ORDINANCE; MAKING MISCELLANEOUS PROVISIONS AND REPEALING ALL ORDINANCES IN CONFLICT. WHEREAS, on March 26, 1979, Entex, Inc. filed its Statement of Intent to change rates in the) (ity of Baytown, Texas, such increases to be effective with all billing after May 1, 1979; and WHEREAS, after reasonable notice, the City Council has considered all testimony and evidence which has been offered and wishes to pass upon the request of Entex, Inc. for a rate increase; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the Code of Ordinances of the City of Baytown is hereby amended by amending Chapter 31, "Utilities ", Article II, Natural Gas Service, by repealing Section 31 -18 as it presently exists and by substituting in its place a new Section 31 -18 which shall read as follows, to wit: Sec. 31 -18. Rates and charges. That Entex, Inc., its successors and assigns, is hereby authorized to place into effect the following schedules of rates within the corporate limits of the City of Baytown, Texas, for supply of natural gas and natural gas service: RESIDENTIAL RATE APPLICATION OF SCHEDULE This schedule is applicable to consumers receiving gas for uses usual in a home through a single meter serving a single family dwelling and its related structures. MINIMUM MONTHLY BILL Effective May 1, 1979, the minimum monthly bill shall be $4.97 net. PAYMENT The above net monthly rates will apply to all bills paid by date indicated on bill. For bills not paid by indicated date, gross rates shall apply, which rates shall be the above net rates plus ten percent (10 %), not to exceed $3.00. COMMERCIAL RATE APPLICATION OF SCHEDULE This schedule is applicable to consumers using gas for purposes other than residential whose consumption in any month is less than 150,000 cubic feet. When a customer uses in excess of 150,000 cubic feet in any month, the consumer shall be billed on the applicable large volume rate schedule. Natural gas supplied hereunder is for the individual use of the customer at one point of delivery and shall not be resold or shared with others. For bills not paid by indicated date, gross rates shall apply, which rates shall be the above net rates plus ten percent (10Q1o), not to exceed $5.00. -2- 9- .,411 -1b Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to the end provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect immediately from and after its passage by the affirmative vote of the City Council of the City of Baytown and the rates provided for herein shall be effective for all bills rendered after May 1, 1979.
