AN ORDINANCE ACCEPTING THE BID OF HOLZAEPFEL CONSTRUC-
TION COMPANY INC. FOR THE CONSTRUCTION OF A PAVILION AT
JENKINS- HOLLAWAY PARK; AND AUTHORIZING THE CONTRACTING
OF INDEBTEDNESS BY THE CITY FOR THE SUM OF FORTY -SEVEN
THOUSAND SIXTY -FOUR AND N01100 ($47,064.00) DOLLARS
WITH REGARD TO SUCH AGREEMENT.
WHEREAS, the City Council of the City of Baytown did
authorize the City's Consulting Engineers to advertise for
bids for the construction of a pavilion at Jenkins - Hollaway
Park to be received March 13, 1979; and
WHEREAS, notice to bidders as to the time and place,
when and where the contract for said construction would be
let was published pursuant to provisions of TEX.REV.CIV.STAT.
art. 2368a; and
WHEREAS, all bids were opened and publicly read at City
Hall at 10:00 a.m., as per published notice to bidders; NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: That the City Council of the City of Baytown
hereby accepts the bid of Holzaepfel Construction Company
Inc. according to the plans and specifications set forth by
the Consulting Engineers on a construction timetable of 45
working days for the sum of Forty -Seven Thousand Sixty -Four
and No /100 ($47,064.00) Dollars, and the Mayor and City
Clerk of the City are hereby authorized and directed to
execute and attest to a contract with Holzaepfel Construction
Company Inc. for the construction of said pavilion containing
the plans, specifications, and requirements of the City's
Consulting Engineers and appropriate bond and drawn provisions
in accordance with the provisions of TEX.REV.CIV.STAT. art.
5160.
Section 2: That pursuant to the provisions of TEX.REV.
CIV.STAT. art. 2368a, the City Manager is hereby granted

general authority to approve any change order involving a
decrease or an increase in costs of Five Thousand and No /100
($5,000.00) Dollars or less, subject to the proviso that the
original contract price may not be increased by more than
twenty -five (250) percent or decreased by more than twenty -
five (25%) percent without the consent of the contractor to
such decrease.
Section 3: This ordinance shall take effect from and
after its passage.
