ORDINANCE NO. 2639
AN ORDINANCE AUTHORIZING ABANDONMENT OF A PORTION OF
THE UTILITY EASEMENT FROM NORTH TENTH TO NORTH ELEVENTH
TO THE TRINITY TABERNACLE ASSEMBLY OF GOD; PROVIDING
FOR THE QUITCLAIMING OF THE CITY'S INTEREST IN SAID
LAND; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, Trinity Tabernacle Assembly of God is the sole
user of the utility easement from North Tenth to North
Eleventh and a public need for such easement no longer
exists; and
WHEREAS, Trinity Tabernacle Assembly of God is the
abutting land owner to the utility easement and has made
application that same be discontinued and abandoned as an
easement; and
WHEREAS, it appears that Trinity Tabernacle Assembly of
God is a charitable institution within the scope and intent
of Resolution No. 557 establishing a procedure for abandonment
of easements; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: That the utility easement from North Tenth
to North Eleventh (and described more fully in Exhibit "A"
attached hereto) is hereby abandoned and permanently vacated
as an utility easement of any kind or character whatever.
Section 2: That the interest or interests of the City
and /or public in the said easement is hereby quitclaimed to
the adjacent owner.
Section 3: That the Mayor and City Clerk are hereby
authorized to execute such instruments, if any, necessary
for such abandonment.
Section 4: That this ordinance is to become effective
from and after its passage.
INTRODUCED, READ, and PASSED by the affirmative vote of
a majority of the City Council of the City of Baytown this
8th day of March , 1979.

A twelve (12) foot ground easement out of the William Wright
300 acres in the Wm. Scott Lower League, Harris County,
Texas, said tract being a part of that certain tract described
in deed from Wright to Cooke in Volume 1280 at Page 734 of
the Deed Records of Harris County, Texas, and being more
fully described by metes and bounds as follows, to wit:
BEGINNING at the Northwest corner of Trinity Tabernacle
Assembly of God 4 acre tract, being the Northeast
corner of the Cooke Tract, said Northwest corner described
as situated North 21 deg. 19 min. East 411.7 feet;
South 68 deg. 41 min. East 120 feet from the point of
intersection of the East line of North 10th Street with
the North line of East Lobit Street;
THENCE, over and across Trinity Tabernacle Tract, South
68 deg. 41 min. East, passing at 170 feet an intra
corner Trinity Tabernacle Tract, in all to a total
distance of 342.87 feet to corner, said corner situated
in the West line of the Redeemer Lutheran Church 5 acre
tract;
THENCE, South 20 deg. 59 min. West, with the dividing
line of Trinity Tabernacle and Redeemer Lutheran Church
Tracts, 12 feet to corner;
THENCE, North 68 deg. 41 min. West, said call parallel
to the first call but 12 feet perpendicular therefrom a
total distance of 342.93 feet to corner, being situated
in the dividing line of the Trinity Tabernacle Assembly
of God and John C. Cooke Tracts;
THENCE, with the dividing line of the Trinity Tabernacle
Assembly of God and John C. Cooke Tracts, North 21 deg.
19 min. East 12 feet to the POINT OF BEGINNING.
