AN ORDINANCE ACCEPTING THE BID OF H. B. HAMILTON CON-
STRUCTION COMPANY FOR THE DEVELOPMENT OF BAYTOWN BICEN-
TENNIAL PARK PHASE II AND AUTHORIZING THE CONTRACTING
OF INDEBTEDNESS BY THE CITY FOR THE SUM OF TWENTY
THOUSAND EIGHT HUNDRED TWENTY -FIVE AND NO 1100 ($20)825.00)
DOLLARS WITH REGARD TO SUCH AGREEMENT.
WHEREAS, the City Council of the City of Baytown did
authorize the Administration to advertise for bids for the
development of Baytown Bicentennial Park Phase II; and
WHEREAS, notice to bidders as to the time and place,
when and where the contract for said construction would be
let was published pursuant to provisions of Texas Revised
Civil Statutes, article 2368a; and
WHEREAS, all bids were opened and publicly read at City
Hall at 9:30 o'clock a.m., Wednesday, February 14, 1979, as
per published notice to bidders; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: That the City Council of the City of Baytown
hereby accepts the bid of H. B. Hamilton Construction Company
according to the plans and specifications set forth by the
City Engineer, on a construction timetable of ninety (90)
working days, for the sum of Twenty Thousand Eight Hundred
Twenty -Five and No /100 ($20,825.00) Dollars.
Section 2: The Mayor and City Clerk of the City are
hereby authorized and directed to execute and attest to a
contract with H. B. Hamilton Construction Company for the
development of Baytown Bicentennial Park Phase II containing
the plans, specifications, and requirements of the City
Engineer and appropriate bond and drawn provisions in accor-
dance with the provisions of Texas Revised Civil Statutes,
article 5160.
Section 3: That, pursuant to the provisions of article
2368a, section 2a, Texas Revised Civil Statutes, the City

Manager is hereby granted general authority to approve any
change order involving a decrease or an increase in costs of
Five Thousand and No /100 ($5,000.00) Dollars or less, subject
to the proviso that the original contract price may not be
increased by more than twenty -five (25x0) percent or decreased
by more than twenty -five (25%) percent without the consent
of the contractor to such decrease.
Section 4: This ordinance shall take effect from and
after its passage.
INTRODUCED, READ, and PASSED by the affirmative vote of
the City Council on this 22nd day of Februar.y 1979.
