ORDINANCE NO. 2627
AN ORDINANCE AUTHORIZING ABANDONMENT AND CONVEYANCE OF
A PORTION OF CITY PROPERTY ADJACENT TO LOTS 2, 3, 4, 5,
AND 6, BLOCK 2, LAMAR COURTS SUBDIVISION; MAKING VARIOUS
FINDINGS AND PROVISIONS RELATED THERETO.
WHEREAS, there presently exists a twelve (12') foot
alley and utility easement extending along the rear (west)
property line of Lots 2, 3, 4, 5, and 6, Block 2 of Lamar
Courts Subdivision; and
WHEREAS, the owner of the adjacent property has requested
that the City abandon and convey to him a portion of this
easement; and
WHEREAS, Texas Revised Civil Statutes, Article 5421c
provides that the City may sell narrow strips and irregular
shaped pieces of land for market value without the necessity
of taking bids; and
WHEREAS, City Council finds and determines that the
fair market value of the property described in Exhibit "A"
is 380 a square foot; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: Upon approval from utilities franchised by
the City and execution of appropriate easements, the sale of
the property described in Exhibit "A ", to Vern Fuller is
hereby authorized on a unit price basis for the sum of 380 a
square foot, and the Mayor and City Clerk are authorized and
directed to execute such instruments, if any, necessary for
conveyance.
Section 2: This ordinance shall become effective from
and after its passage.
INTRODUCED, READ, and PASSED by the affirmative vote of
the majority of the City Council of the City of Baytown this
8th day of February , 1979.
