Ordinance No. 2,557id ORDINANCE NO. 2557 81012 -2 AN ORDINANCE AMENDING ARTICLE II, BOARDS AND COMMISSIONS, OF CHAPTER 2, "ADMINISTRATION," OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY ADDING THERETO A NEW PROVISION TO BE DESIGNATED DIVISION 1 TO ESTABLISH THE BAYTOWN CLEAN CITY COMMISSION; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: There is hereby added to Article II of Chapter 2 of the Code of Ordinances of the City of Baytown the following provisions which shall be designated as Division 1 and which shall hereafter read as follows, to wit: DIVISION 1 The Baytown Clean City Commission Sec. 2 -15. Creation. There is hereby established the Baytown Clean City Commis- sion to direct and oversee a comprehensive litter control program for the purpose of reducing and controlling at an acceptable level the concentration of litter in the city and to bring about a long -term improvement in the attitudes and trash handling habits of citizens. Sec. 2 -16. Definition. "Litter," for the purposes of this article, shall mean uncontrolled refuse or trash on public or private property. Sec. 2 -17. Appointment of commission. The Baytown Clean City Commission shall consist of nine members to be appointed by the City Council. The members of such committee shall serve at the pleasure of the City Council and may be removed by City Council with or without cause. Sec. 2 -17.1. Terms of commissioners. The terms of the members appointed as members of the Baytown Clean City Commission shall be as follows: a. Four of the initial nine commissioners appointed by the City Council shall be designated by the City Council to serve a one year term. The remaining five commissioners shall be appointed for two year terms. W 81012 -2a b. Subsequent terms of all commissioners shall be for two years. C. Appointments to vacancies shall be for the unexpired term of the position to which the appointment is made. d. Commissioners shall serve until their successors have been appointed and confirmed. Sec. 2 -18. No compensation for commissioners. Commissioners of the Baytown Clean City Commission shall serve without compensation. Sec. 2 -19. Election and term of chairman. The Baytown Clean City Commission shall organize by electing one of its members as chairman and such chairman shall hold office for one year or until his successor has been elected and qualified. Sec. 2 -20. Adoption of administrative procedures. The Baytown Clean City Commission may adopt such adminis- trative procedures as are necessary to accomplish the pur- poses set out in this division. Sec. 2 -21. Written reports. The Commission shall each year, during the month of November, submit a written report to the Mayor and City Council summarizing the status of the Clean City Program. Sec. 2 -22. Consultation with city officers and departments. The Director of the Public Works Department of the city and other city officers and staffs of city departments may consult with and advise the Baytown Clean City Commission from time to time on matters coming within the scope of this division and the Commission may consult with and advise such city officers and personnel of such departments. Sec. 2 -23. Solicitation of funds. The Baytown Clean City Commission shall have the authority to solicit funds and donations to carry out the purposes for which it is herein established. Sec. 2 -24. Additional powers. The Baytown Clean City Commission may contract with any person, organization or corporation for purposes consistent with this Act's purpose of reducing and controlling litter. Any such contract must be presented to the City Council for approval prior to execution.
