ORDINANCE NO. 2552
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
AUTHORIZING THE INSTALLATION OF TRAFFIC CONTROL SIGNALS
ON DECKER DRIVE (SPUR 330) AT THE INTERSECTION OF
FAIRWAY DRIVE; PROVIDING FOR THE APPROVAL OF THE AGREE-
MENT DATED SEPTEMBER 28, 1978, BETWEEN THE STATE OF
TEXAS AND THE CITY OF BAYTOWN FOR THE INSTALLATION,
CONSTRUCTION, EXISTENCE, USE, OPERATION, AND MAINTENANCE
OF HIGHWAY SIGNAL PROJECTS AT THAT LOCATION IN THE CITY
OF BAYTOWN; PROVIDING FOR THE EXECUTION OF SAID AGREEMENT;
PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND N01100
($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION
AND EFFECTIVE DATE HEREOF.
WHEREAS, Texas Revised Civil Statutes article 6701d
provides that local authorities in their respective jurisdiction
may place and maintain any traffic control device upon any
highway under their jurisdiction as they may deem necessary,
taking into consideration the usual traffic flow of the
streets or highways within their jurisdiction. Said governing
body may determine that various local traffic control devices
are necessary and shall direct said appropriate devices be
erected by the passage of an ordinance, which shall be
effective when appropriate signs giving notice thereof are
erected at such intersection or other place or part of the
street or highway; and
WHEREAS, article 6701d further provides that no local
authority shall erect or maintain any traffic - control device
at any location so as to require the traffic on any State
highway, including Farm -to- Market or Ranch -to- Market roads,
to stop or yield before entering or crossing any intersecting
highway unless such device is erected and maintained by
virtue of an agreement entered into between such local
authority and the State Department of Highways and Public
Transportation; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:

Section 1: That on the basis of an engineering and

traffic study heretofore made as authorized by the provisions
of Texas Revised Civil Statutes article 6701d, traffic
control signals, are authorized to be placed on Decker Drive
(Spur 330) at the intersection with Fairway Drive.
Section 2: That the certain agreement dated September
280 1978, between the State of Texas and the City of Baytown,
for the installation, construction, existence, use, operation,
and maintenance of certain highway traffic signals at the
intersection of Decker Drive (Spur 330) and Fairway Drive,
in the City of Baytown, be and the same is hereby approved,
and the Mayor of the City of Baytown is hereby authorized to
execute said agreement on behalf of the City of Baytown, and
transmit the same to the State of Texas for appropriate
action.
Section 3: It shall be unlawful for a driver of a
vehicle to disobey the signals installed in accordance with
the provisions of this ordinance, unless at the time otherwise
directed by a police officer.
Section 4: Any person violating the provisions of this
ordinance shall be punished by a fine of not more that Two
Hundred ($200.00) Dollars and each violation shall constitute
a separate offense.
Section 5: This ordinance shall take effect from and
after ten (10) days after its passage by the City Council.
The City Clerk is hereby directed to give notice hereof by
causing the caption of this ordinance to be published in the
official newspaper of the City of Baytown at least twice
within ten (10) days after its passage.
INTRODUCED, READ, and PASSED by the affirmative vote of
the City Council on this 28th day of September , 1978.
