AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
AMENDING CHAPTER 28J, "TAXATION," BY REPEALING SUBSECTION
28J.1(b) AS PRESENTLY CONSTITUTED AND SUBSTITUTING IN
ITS PLACE THE PROVISIONS OF A NEW SUBSECTION 281.1(b);
REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING
A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: That the Code of Ordinances of the City of
Baytown is hereby amended by the amendment of Chapter 28�,
"Taxation," by repealing Subsection 28�.1(b) thereof, and
the same shall cease to have force and effect from and after
the effective date of this ordinance.
Section 2: That the Code of Ordinances is hereby
amended by adding thereto the provisions of a new Subsection
281.1(b) which shall read as follows, to wit:
Sec. 28J.1. Exceptions to payment of ad valorem taxes.
(b) Subject to the provisions hereof, from and after
January 1, 1978, $10,000.00 of the assessed value of
residence homesteads, as defined by the laws of the
State of Texas, of married or unmarried persons sixty -
five (65) years of age or older, including those living
alone shall be exempted from ad valorem taxes levied by

Section 4: Savings Clause: If any provision, section,
exception, subsection, paragraph, sentence, clause or phrase
of this ordinance or the application of same to any person

or set of circumstances, shall for any reason be held uncon-
stitutional, void or invalid, such invalidity shall not
affect the validity of the remaining provisions of this
ordinance or their application to other persons or sets of
circumstances and to this end all provisions of this ordinance
are declared to be severable.
Section 5: Effective Date: This ordinance shall take
effect from and after its passage by the City Council of the
City of Baytown.
