AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER
AND CITY CLERK TO EXECUTE AND ATTEST TO A CONTRACT WITH
THE RETIRED SENIOR VOLUNTEER PROGRAM FOR THE REGISTRATION,
RECRUITMENT, AND COORDINATION OF SENIOR VOLUNTEER
COMMUNITY SERVICE; AND APPROPRIATING THREE THOUSAND SIX
HUNDRED AND N01100 ($3,600.00) FROM REVENUE SHARING
FUNDS WITH REGARD TO SUCH AGREEMENT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: That the City Council of the City of Baytown
hereby approves the contract with the Retired Senior Volunteer
Program and authorizes and directes the City Manager and
City Clerk of the City of Baytown to execute and attest to
said contract. A copy of said contract is attached hereto,
marked Exhibit "A," and made a part hereof for all intents
and purposes.
Section 2: That the City Manager of the City of Baytown
is hereby authorized to appropriate Three Thousand Six
Hundred and No /100 ($3,600.00) Dollars from Account No.
04- 099 -00, Surplus, to Account No. 04- 179 -70, Social Services.
Section 3: This ordinance shall take effect from and
after its passage.
INTRODUCED, READ, and PASSED by the affirmative vote of
the City Council of the City of Baytown this 24th day
of August 1978.

AGREEMENT
THE STATE OF TEXAS
COUNTY OF HARRIS 0

THIS AGREEMENT, made and entered into by and
between the City of Baytown, a municipal corporation, here-
inafter called "City," and the Retired Senior Volunteer
Program, hereinafter called the "Program Applicant."
WITNESSETH:
WHEREAS, the Retired Senior Volunteer Program has
been organized to strengthen and supplement efforts to meet
a broad range of human, social, and environmental needs by
encouraging and enabling constructive volunteer service in
agencies, institutions, and situations where the application
of human talent and dedication may help to meet such ends;
and
WHEREAS, the City Council of the City of Baytown
has determined that such a program to help retired persons
avail themselves of opportunities for volunteer service in
the community is in the public interest; NOW THEREFORE, KNOW
ALL MEN BY THESE PRESENTS:
That in consideration of the mutual convenants,
agreements and benefits to both parties, it is agreed as
follows:
I.
The Program Applicant, as independent contractor,
agrees, in accordance with the terms of their project
application (attached hereto and made a part hereof for all
intents and purposes) to register non - profit and public
agencies and institutions in the City of Baytown that are in
need of volunteers, to recruit men and women over sixty to
act as volunteers, to support and publicize these Senior
Volunteers, and to do all other acts necessary for the
successful operation of this civic enterprise.

This agreement is to cover services to be rendered
from September 1, 1978, to September 30, 1979.
III.
The City agrees to pay to Retired Senior Volunteer
Program the sum of Three Thousand Six Hundred and No /100
($3,600.00) Dollars for service to be rendered in the
development, organization, supervision, and management of
this program, but in no event will the City pay more.
IV.
In performance of the services agreed to herein,
the Program Applicant agrees to observe and strictly comply
with, all the terms, conditions, rules, and regulations of
all applicable federal, state, and city statutes.
V.
It is expressly agreed and understood by all
parties hereto that the Program Applicant is an independent
contractor in its relationship to the City of Baytown.
Nothing herein contained at any time or in any manner shall
be construed to effect an agreement of partnership or joining
venture or render any party hereto the employer or master of
any other party and /or its employees, agents or representatives.
VI.
The Program Applicant agrees to indemnify, and
does hereby indemnify, hold harmless and defend, the City of
Baytown, its agents, servants, or employees, from and against
any and all claims for damages or injuries to persons or
property, whether real or asserted, arising out of or incident
to the operation of this program.
