Ordinance No. 2,512ia , ORDINANCE NO. 2512 0727 7 AN ORDINANCE AMENDING SECTION 7 -5.1, MINIMUM PROPERTY STANDARDS FOR ONE AND TWO LIVING UNITS -- AMENDMENTS, OF THE CODE OF ORDINANCES TO ESTABLISH MINIMUM DISTANCES BETWEEN STRUCTURES AND PROPERTY LINES: REPEALING CON- FLICTING ORDINANCES; CONTAINING A SAVINGS CLAUSE AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the Code of Ordinances of the City of Baytown is hereby amended by the repeal of Chapter 7, "Buildings ", Section 7 -5.1, Minimum Property Standards for One and Two Living Units -- Amendments, as presently constituted and by substituting in its place a new Section 7 -5.1 which shall read as follows: Sec.7 -5.1. Minimum property standards for one and two living units -- amendments. Section 503 -2 of the minimum property standards for one and two living units (FHA No. 300) is hereby amended so as to repeal that section as presently constituted and to substitute in its place a new section 503 -2.1 which shall read as follows: Section 503 -2.1. Minimum distance from front or rear building line to property line, at any point, 15 feet, except a garage or carport to rear property line, 5 feet minimum. A carport which is open on three sides (the side nearest the front property line and the two adjacent sides, or if located on a corner lot and entering the secondary street, the side nearest to the secondary street and the two adjacent sides) may have an overhang extending to the front property line (or side property line in the case of a car- port on a corner lot entering on the secondary street) with no structural post installed closer than 3 feet from the property line. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this (" ordinance. id '0727 -7a Section 3: If any provision, section, exception, sub- section, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the valid- ity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect from and after its passage.
