Ordinance No. 2,511ORDINANCE NO. 2511 0727 -6 AN ORDINANCE AUTHORIZING THE MERGER OF ITS CURRENT PENSION PLAN FOR VOLUNTEER FIREMEN WITH THE PENSION SYSTEM PROVIDED BY THE VOLUNTEER FIRE FIGHTERS' RELIEF AND RETIREMENT FUND ACT (S.B. 411) AND MAKING VARIOUS FINDINGS AND PROVISIONS RELATED THERETO. WHEREAS, the Texas Legislature passed Senate Bill 411 relating to the creation and administration of a fire fighter's relief and retirement fund for firefighters who serve without monetary remuneration; and WHEREAS, on September 8, 1977, City Council exempted itself from the requirements of the Volunteer Fire Fighters' Relief and Retirement Fund Act (S.B. 411); and WHEREAS, the members of the local volunteer fire depart- ment have elected to merge its current pension plan with the system provided by that Act; and WHEREAS, after further study and observation of the implementation of the Act, the City Council desires to rescind its exemption from that Act; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: City Council rescinds its exemption from the requirements of the Volunteer Fire Fighters' Relief and Retirement Fund Act (S.B. 411) and hereby elects to merge its current pension plan with the pension system on the buy back method provided by said Act. Section 2: City Council hereby directs the City Clerk to make all the disclosures, if any, required by section 16 of the Act. Section 3: No person less than eighteen (18), nor more than thirty -five (35) years of age, may become a member of the pension system. Sa 0727 -6a Section 4: No more than one hundred twenty (120) persons may become members of the pension system through the local volunteer fire department.
