Ordinance No. 2,509W ORDINANCE NO. 2509 10727 -4 AN ORDINANCE ACCEPTING THE BID OF SHUR -FLO, INC. FOR THE SLIPLINING OF CERTAIN SANITARY SEWER LINES AS ENUMERATED IN CITY OF BAYTOWN BID NO. 787 -80 AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF ONE HUNDRED NINETY -SEVEN THOUSAND ONE HUNDRED SEVENTY -NINE AND 50/100 ($197,179.50) DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS, the City Council of the City of Baytown did authorize the administration to advertise for bids for the sliplining of certain sanitary sewer lines as enumerated in City of Baytown Bid No. 787 -80 to be received July 17, 1978; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of TEX.REV.CIV.STAT., art. 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 2:00 p.m., Monday, July 17, 1978, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown hereby accepts the bid of Shur -Flo, Inc. according to the plans and specifications set forth by the administration on a construction timetable of 120 working days for the sum of One Hundred Ninety -Seven Thousand One Hundred Seventy -Nine and 50/100 ($197,179.50) Dollars, and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Shur -Flo, Inc. for the sliplining of said sanitary sewer lines, containing the plans, specifications, and requirements of the administration and appropriate bond and drawn provisions in accordance with the provisions of TEX.REV.CIV.STAT., art. 5160. id 0727 4 a Section 2: That, pursuant to the provisions of TEX.REV. CIV.STAT., art. 2368a, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, subject to the proviso that the original contract price may not be increased by more than twenty -five (25%) percent or decreased by more than twenty - five (25°x) percent without the consent of the contractor to such decrease.
