ORDINANCE NO. 2496
AN ORDINANCE AMENDING SECTION 18 -51, PARKING PROHIBITED
FOR CERTAIN VEHICLES AND PURPOSES, OF THE CODE OF
ORDINANCES TO PROHIBIT OBSTRUCTION OF INTERSECTIONS;
PROVIDING FOR A MAXIMUM PENALTY OF TWO HUNDRED AND
N01100 ($200.00) DOLLARS; REPEALING CONFLICTING ORDI-
NANCES; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR
THE PUBLICATION AND EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: That the Code of Ordinance of the City of
Baytown is hereby amended by the repeal of Chapter 18,
"Motor Vehicles and Traffic," Article VI, Stopping, Standing
and Parking, Section 18 -51, as presently constituted and by
substituting in its place a new Section 18 -51 which shall
read as follows:
Sec. 18 -51. Parking prohibited for certain vehicles and
purposes.
(a) A person commits an offense if he stops, stands or
parks upon a public street:
(1) A commercial motor vehicle, truck tractor, trailer,
or semitrailer in a residence district at night;
(2) A vehicle for the purpose of repair, service, or
displaying it for sale or;
(3) A vehicular habitation at night (whether occupied
or not).
(b) It is an exception to the application of this subsection
(a)(1) if the vehicle's manufacturers rated carrying capacity
does not exceed two thousand (2,000) pounds.
(c) It is an exception to the enforcement of subsection
(a)(1) and /or (a)(3) if the vehicle or trailer is a customized
van, motor home, travel trailer, truck camper or mobile home
that is less than twenty -nine (29) feet long and is currently
licensed for highway travel; and
(1) The street has sufficient width to allow a minimum
clearance of twenty -four (24) feet for two -way traffic
and fifteen (15) feet for one -way traffic movement at
the parking site; and
(2) No driveway exits or conflicts across the street
from the parking site; and
(3) The vehicle or trailer has adequate reflective
devices on the street side; and

(4) The vehicle or trailer is used for temporary
habitation and only on vacation or trips; and
(5) The parking would not violate any applicable deed
restrictions; and
(6) The vehicle or trailer has been so parked for less
than seventy -two (72) hours.
(d) A person commits an offense if he stops, stands or
parks upon an alley so as not to leave ten (10) feet
available for traffic movement.
(e) A person commits an offense if he stops, stands or
parks a vehicle in an intersection so as to obstruct any
traffic movement on the intersecting street.
(f) It shall be a defense to any prosecution of this
section if such repair or service was necessitated by emergency
or breakdown.
Section 2: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby
repealed; provided, however, that such repeal shall be only
to the extent of such inconsistency and in all other respects
this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered by this
ordinance.
Section 3: If any provision, section, exception,
subsection, paragraph, sentence, clause or phrase of this
ordinance or the application of same to any person or set of
circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity
of the remaining provisions of this ordinance or their
application to other persons or sets of circumstances and to
this end all provisions of this ordinance are declared to be
severable.
Section 4: This ordinance shall take effect from and
after ten (10) days after its passage by the City Council.
The City Clerk is hereby directed to give notice hereof by
causing the caption of this ordinance to be published in the
official newspaper of the City of Baytown at least twice
within ten (10) days after its passage.
