ORDINANCE NO. 2490
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
AMENDING THE "CITY OF BAYTOWN PERSONNEL RULES" RELATING
TO VACANCY IDENTIFICATION, LONGEVITY PAY, VACATION AND
SICK LEAVE TERMINATION PAY, ABSENCE WITHOUT LEAVE, AND
RETIREMENT; PROVIDING A REPEALING CLAUSE, A SAVINGS
CLAUSE, AND THE EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of Baytown,
Texas, heretofore by the adoption of Ordinance No. 2023,
prescribed rules and regulations concerning employees of the
City of Baytown entitled "City of Baytown Personnel Rules ",
three (3) copies of which are on file with the City Clerk of
the City of Baytown; and
WHEREAS, it is necessary to amend said personnel policy;
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: That the "City of Baytown Personnel Rules"
are hereby amended by the repeal of Chapter 2, Section 1,
Vacancy Identification, as presently constituted and substituting
in its place a new Section 1 which shall read as follows:
Chapter 2
Section 1-- Vacancy Identification
Department Heads shall notify the Personnel Department
when vacancies occur or are imminent by using the appropriate
means as prescribed by the Personnel Director.
Section 2: That the "City of Baytown Personnel Rules"
are hereby amended by the repeal of Chapter 7, Section 5,
Longevity, as presently constituted and substituting in its
place a new Section 5 which shall read as follows:
Chapter 7
Section 5-- Longevity
Regular full -time non -civil service employees shall be
entitled to four dollars ($4.00) per month for each year of
service to the City, not to exceed twenty -five years.

Longevity for civil service employees should be consistent
with the rates provided by TEX.REV.CIV.STAT. art. 12690.
Regular part -time and temporary employees shall not accrue
longevity.
Section 3: That the "City of Baytown Personnel Rules"
are hereby amended by the repeal of Chapter 8, Section 2,
Vacation, subsection (f), as presently constituted and
substituting in its place a new subsection (f) which shall
read as follows:
Chapter 8
Section 2 -- Vacation
(f) Employees who have completed their probationary
period, who are separated from City service for any reason
shall be payed for any unused vacation leave up to but not
greater than the maximum vacation accrual leave.
Section 4: That the "City of Baytown Personnel Rules"
are hereby amended by the repeal of Chapter 8, Section 3,
Sick Leave, subsection (g), as presently constituted and
substituting in its place a new subsection (g) which shall
read as follows:
Chapter 8
Section 3 - -Sick Leave
(g) Employees, who have completed their probationary
period, who are separated from City service for any reason
shall be paid for any accrued sick leave up to a maximum of
90 days. If an employee is employed more than once by the
City, he or she shall be paid for accrued sick leave based
upon the balance remaining of the 90 day maximum.
Section 5: That the "City of Baytown Personnel Rules"
are hereby amended by the repeal of Chapter 8, Section 8,
Absence Without Leave, as presently constituted and substituting
in its place a new Section 8 which shall read as follows:
Chapter 8
Section 8-- Absence Without Leave (Lost Time)
An employee failing to report for duty or remain at
work as scheduled without proper notification, authorization,
or excuse shall be considered absent without leave and shall
not be in pay status for the time involved.
Absence without leave constitutes abandonment of duties,
which may result in dismissal.

Section 6: That the "City of Baytown Personnel Rules"
are hereby amended by the repeal of Chapter 11, Section 4,
Retirement, as presently constituted and substituting in its
place a new Section 4 which shall read as follows:
Chapter 11
Section 4 -- Retirement
Eligible employees may be separated by retirement in
accordance with applicable programs. Permanent employees
shall be retired from employment on the last day of the
calendar year in which their seventieth (70) birthday occurs.
An employees retirement may be deferred by his or her consent
and with the approval of the City Manager and the City
Council provided the employee is able to pass an appropriate
physical examination. Retirement deferments shall be granted
on a year to year basis.
Section 7: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby
repealed; provided, however, that such repeal shall be only
to the extent of such inconsistency and in all other respects
this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter of this ordinance.
Section 8: If any provision, exception, section,
subsection, paragraph, sentence, clause or phrase of this
ordinance or the application of same to any person or set of
circumstances shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity
of the remaining provisions of this ordinance or their
application to other persons or sets of circumstances and to
this end, all provisions of this ordinance are declared to
be severable.
Section 9: This ordinance shall take from and after
its passage by the City Council of the City of Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of
the City Council of the City of Baytown on this 22nd day
of June 1978.
