Ordinance No. 2,4821 80608 -4 ORDINANCE NO. 2482 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN ACCEPTING THE BID OF CHATHAM CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF A POLICE GARAGE AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF TWENTY -NINE THOUSAND SIX HUNDRED AND N01100 ($29,600.00) DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS, the City Council of the City of Baytown did authorize the City Engineer to advertise for bids for the construction of a police garage to be received May 31, 1978; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of TEX.REV.CIV.STAT., art. 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 2:00 o'clock p.m., as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown hereby accepts the bid of Chatham Construction Company according to the plans and specifications set forth by the City Engineer on a construction timetable of 60 days for the sum of Twenty -Nine Thousand Six Hundred and No /100 ($29,600.00) Dollars, and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Chatham Construction Company for the construction of said garage containing the plans, specifications, and require- ments of the City Engineer and appropriate bond and drawn provisions in accordance with the provisions of TEX.REV.CIV. STAT., art. 5160. 80608 -4a Section 2: That pursuant to the provisions of TEX.REV. CIV.STAT., art. 2368a, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, subject to the proviso that the original contract price may not be increased by more than twenty -five (25 %) percent or decreased by more than twenty - five (25 %) percent without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
