Ordinance No. 2,478p ...5;- �,..�► -mod '- s� �� 3 a ORDINANCE NO. 2478 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN ADDING WHISPERING PINES SUBDIVISION, SECTION 4, TO COUNCIL DISTRICT NO. 4; REPEALING ORDINANCES INCONSIS- TENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PRO- VIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. WHEREAS, Section 17(1) of the Charter of the City of Baytown provides that the City Council shall redistrict the City if the growth of the City justifies; and WHEREAS, it is necessary to include the newly annexed territory, Whispering Pines Subdivision, Section 4, in a Council District; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: Council District No. 4 is hereby redistricted by the addition of Whispering Pines Subdivision, Section 4, which is more particularly described as follows: BEING a tract or parcel of land out of the Christian Smith Survey, A -69, Harris County, Texas, and being a part of that certain 90.276 acre tract conveyed to Bayou Ltd., and being more particularly described by metes and bounds as follows: COMMENCING at the Southwest corner of the above mentioned 90.276 acre tract and the Northwest corner of Whispering Pines Section One as evidenced by plat filed for record in Volume 194 at Page 63 of the Map Records of Harris County, Texas; THENCE, North 800 14' 8" East with the South line of the 90.276 acre tract and the North line of Whispering Pines Section One a distance of 1198.83' to a point situated in the centerline of a 60' easement to the Harris County Flood Control District as recorded in Volume 2197 at Page 357 of the Deed Records of Harris County, Texas, for the POINT OF BEGINNING of the tract herein described; THENCE, from the POINT OF BEGINNING North 800 14' 8" East continuing with the South line of the above men- tioned 90.276 acre tract and the North line of Whis- pering Pines Section One and Two a distance of 1539.83' to a point situated at the waters edge of Cedar Bayou Stream; 85 -7a THENCE, in a Northerly direction with the meander of the West bank of Cedar Bayou and the East line of this tract North 380 32' 51" West, a distance of 172.541, North 80 52' 12" West a distance of 140.35', North 220 49' 38" East a distance of 502.581, North 00 47' 36" East a distance of 88.50' to a point for the Northeast corner of this tract; THENCE, South 800 29' 54" West with the North line of this tract a distance of 1738.29' to a point situated in the centerline of the aforementioned Harris County Flood Control Ditch; THENCE, South 90 13' 36" East with the centerline of the aforementioned Harris County Flood Control Ditch a distance of 810.00 to the POINT OF BEGINNING, enclosing 28.956 acres more or less. (Whispering Pines, Section 4) Section 2: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: Savings Clause: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held uncon- stitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: Effective Date: This ordinance shall take effect immediately from and after its passage and the City Clerk is hereby directed to publish the caption of this ordinance at least once in the official newspaper of the City of Baytown. -2- INTRODUCED, READ, and PASSED by the affirmative vote of a majority of the City Council of the City of Baytown on this the 25th day of May , 1978.
