ORDINANCE NO. 2447
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, ACCEPTING THE BID OF AMISTAD CONSTRUCTION COMPANY
FOR THE DEVELOPMENT OF JENKINS- HOLLAWAY PARK, PHASE II,
AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE
CITY FOR THE SUM OF FIVE HUNDRED EIGHT THOUSAND FOUR
HUNDRED FIFTY -SIX AND 34/100 ($508,456.34) DOLLARS WITH
REGARD TO SUCH AGREEMENT.
WHEREAS, the City Council of the City of Baytown,
Texas, did authorize Busch, Hutchison & Associates, Inc.,
Consulting Engineers for the City of Baytown, to advertise
for bids for the development of Jenkins - Hollaway Park, Phase
II; and
WHEREAS, the plans, specifications, and bid instructions
prepared by the Consulting Engineers provided for the alternate
use of metal halide lighting at two ball fields and at
tennis courts; and
WHEREAS, notice to bidders as to the time and place,
when and where the contract for said construction would be
let was published pursuant to provisions of Vernon's Civil
Statutes, Article 2368a; and
WHEREAS, all bids were opened and publicly read at City
Hall at 10:00 a.m., Tuesday, April 4, 1978, as per published
notice to bidders; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: That the City Council of the City of Baytown,
Texas, hereby accepts the bid of Amistad Construction Company
in accordance with the plans and specifications set forth by
the Consulting Engineers, on a construction timetable of 120
working days, for the sum of Five Hundred Eight Thousand
Four Hundred Fifty -Six and 34/100 ($508,456.34) Dollars.

Section 2: The Mayor and City Clerk of the City are
hereby authorized and directed to execute and attest to a
contract with Amistad Construction Company for the development
of Jenkins - Hollaway Park, Phase II, containing the plans,
specifications, and requirements of the Consulting Engineers
and appropriate bond and drawn provisions in accordance with
the provisions of Vernon's Civil Statutes, Article 5160.
Section 3: That, pursuant to the provisions of Article
2368a, Section 2a, Vernon's Annotated Texas Statutes, the
City Manager is hereby granted general authority to approve
any change order involving a decrease or an increase in
costs of Five Thousand and No /100 ($5,000.00) Dollars or
less, subject to the proviso that the original contract
price may not be increased by more than twenty -five (257o)
percent or decreased by more than twenty -five (25 %) percent
without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect from and
after its passage by the City Council of the City of Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of
the City Council on this 13th day of April , 1978.
