Ordinance No. 2,438Id ORDINANCE NO. 2438 bd 80323 -9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING A CHANGE ORDER TO THE CONTRACT WITH AMISTAD CONSTRUCTION COMPANY FOR THE ELECTRICAL INSTAL- LATION DESIGN AT THE BAYTOWN SPORTS COMPLEX PHASE II AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council does hereby authorize a change order to the contract with Amistad Construction Company for the electrical installation design at the Baytown Sports Complex Phase II. A copy of said change order is attached hereto, marked Exhibit "A," and made a part hereof for all intents and purposes. Section 2: This ordinance shall take effect from and after the date of its passage by the affirmative vote of the City Council of the City of Baytown. Box 424 Baytown, TX 77520 CHANGE ORDER TO AMISTAD CONSTRUCTION COMPANY- ELECTRICAL INSTALLATION DESIGN CHANGE - BAYTOWN SPORTS COMPLEX PHASE II -JOB NO. 77 -1518 When the Phase II development design was made for the Sports Complex, the electrical system was specified to be the same type of construction as that in Phase I. Specifically, the electrical cable, which must be under- ground to meet federal requirements, was called out to be direct burial cable. This means the cable is placed in the ground without protection from damage by digging equipment. Such protection is normally supplied by either a metal or plastic conduit which may or may not be encased in. red concrete. When direct burial cable is used there is usually a red plastic ribbon laid over it at a shallow depth which will warn anyone digging of the presence of a buried electrical cable. This was the con- struction technique employed in Phase I and specified again in Phase II. Such construction meets the National Electrical Code and is considered safe, particularly where the cable is buried in a single owner's property and is therefore closely controlled as is the case with City of Baytown park property. This construction was also used at Pelly Park and at the several lighted tennis courts in town. The need for this change order arises from a change in the Baytown Electrical Code which no longer permits direct burial cable. The code was revised be- tween the design of the Sports Complex Phase I and Phase II developments and now requires that all buried electrical cables in commercial projects must be to conduit and encased in red concrete. This deviation from the National Electrical Code was not picked up when the Phase II design was made and was not called to the engineer's attention until the contractor was preparing to install the direct burial cable. The electrical subcontractor was asked to prepare a cost estimate for the added expense of conduit and red concrete. The figure which was developed and which we feel is reasonable is $5880.00.
