Ordinance No. 2,42280223 , ORDINANCE NO. 2422 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER 18, "MOTOR VEHICLES AND TRAFFIC," BY THE AMENDMENT OF SECTION 18 -51, PARKING PROHIBITED FOR CERTAIN VEHICLES AND PURPOSES, TO PROVIDE TEMPORARY PARKING OF CERTAIN RECREATIONAL VEHICLES ON PUBLIC STREETS; PROVIDING FOR A MAXIMUM PENALTY OF TWO HUNDRED AND N01100 ($200.00) DOLLARS; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown, Texas, is hereby amended by amending Chapter 18, "Motor Vehicles and Traffic," Article VI, Stopping, Standing and Parking, by the addition of a new subsection (e) to Section 18 -51, Parking prohibited for certain vehicles and purposes, which shall read as follows: Sec. 18 -51. Parking prohibited for certain vehicles and purposes. (e) It is an exception to the enforcement of this subsec- tion (a)(1) and /or (a)(3) if the vehicle or trailer is a customized van, motor home, travel trailer, truck camper or mobile home that is less than 29' long and is currently licensed for highway travel; and (1) the street has sufficient width to allow a minimum clearance of 24 feet for two -way traffic and 15 feet for one -way traffic movement at the parking site; and (2) no driveway exits or conflicts across the street from the parking site; and (3) the vehicle or trailer has adequate reflective devices on the street side; and (4) the vehicle or trailer is used for temporary habitation and only on vacation or trips; and (5) the parking would not violate any applicable deed restrictions; and (6) the vehicle or trailer has been so parked for less than 72 hours. 80223 -12a W Section 2: Repealing Clause: All ordinances or parts of ordinances inconsistent with the are hereby repealed; provided howevi shall be only to the extent of such other respects this ordinance shall ordinances regulating and governing covered by this ordinance. terms of this ordinance ar, that such repeal inconsistency and in all be cumulative of other the subject matter Section 3: Savings Clause: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconsti- tutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after its passage.
