Ordinance No. 2,40380126 -8 ORDINANCE NO. 2403 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE BID OF R.T. BISHOP CONSTRUCTION COMPANY, INC., AND R. T. BISHOP, JOINT VENTURE FOR THE CONSTRUCTION OF THE COUNTRY CLUB WATER LINE REPLACEMENT PROJECT AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF THREE HUNDRED TWENTY THOUSAND TWO HUNDRED SEVENTY -THREE AND 25/100 ($320j273.25) DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS, the City Council of the City of Baytown, Texas, did authorize Busch, Hutchinson & Associates, Inc., Consulting Engineers to the City of Baytown to advertise for bids for the construction of the Country Club Water Line Replacement Project to be received January 17, 1978; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of Vernon's Civil Statutes, Article 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 10:00 o'clock a.m., Tuesday, January 17, 1978, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown, Texas, hereby accepts the bid of R. T. Bishop Construction Company, Inc., and R.T. Bishop, Joint Venture (Contractor) according to the plans and specifications set forth by the Consulting Engineers on a timetable of 120 working days for the sum of Three Hundred Twenty Thousand Two Hundred Seventy - Three and 25/100 ($320,273.25) Dollars, and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with said contractor for said construction, containing the plans, specifications, and requirements of the Consulting Engineers and appropriate 80126 -8a bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes, Article 5160. Section 2: That, pursuant to the provisions of Article 2368a, Section 2a, Vernon's Annotated Texas Statutes, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, subject to the provision that the original contract price may not be increased by more than twenty -five (25%) percent or decreased by more than twenty -five (250) percent without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
