Ordinance No. 2,356741�v 64 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER 31, "UTILITIES," OF THE CODE OF ORDINANCES BY AMENDING SECTION 31 -67, SEWER TAPPING FEES; PROVIDING A PENALTY; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Chapter 31, "Utilities," of the Code of Ordinances of the City of Baytown, Texas, is hereby amended by the amendment of Article V, Sewer Service, Section 31 -67, Sewer tapping fees, by the repeal of subsection (a) as presently constituted, and by the addition of a new subsection (a) that shall read as follows, to -wit: ARTICLE V. SEWER SERVICE Sec. 31 -67. Sewer tapping fees. (a) The water billing department shall assess and collect a $70.00 sewer tap fee for each and every four (411) inch sewer tap. All other taps (6" and larger) and other special connections shall be made at estimated actual cost, as determined by the utility office manager, with consultation of the director of public works or his designee. Section 2: Penalty: Any person violating the provisions of this ordinance shall be punished by a fine of not more than Two Hundred and No /100 ($200.00) Dollars, and each violation shall constitute a separate offense. Section 3: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. PW ,,18135 Section 4: Savings Clause: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held uncon- stitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: Effective Date: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
