Ordinance No. 2,325W ORDINANCE NO. 2325 801 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE EXCHANGE OF LAND OWNED BY THE CITY OF BAYTOWN FOR LAND OWNED BY SAN JACINTO METHODIST HOSPITAL; DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO INSTRUMENTS CONVEYING SAID LAND TO SAN JACINTO METHODIST HOSPITAL; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, on the 8th day of April, 1976, the City Council of the City of Baytown adopted Ordinance No. 1984 thereby authorizing the exchange of land owned by the City of Baytown for land owned by San Jacinto Methodist Hospital; and WHEREAS, as a part of this agreement, it was understood that in order for the property acquired by San Jacinto Methodist Hospital to be useful it would be necessary for Price Street and certain utilities situated within the Price Street right of way to be relocated; and WHEREAS, it was further understood that the entire cost of relocation of Price Street and the utilities would be borne by San Jacinto Methodist Hospital; and WHEREAS, San Jacinto Methodist Hospital has completed construction of the new street and wishes to consumate the exchange of the street and rights of way; and WHEREAS, TEX.REV.CIV.STAT. art. 5421c -12 provides that narrow strips of land and streets and alleys may be sold by the City to abutting property owners without the necessity of publication of notices and taking of bids; and WHEREAS, as art. 5421c -12 further provides that any conveyance, sale or trade made pursuant to the provisions thereof shall never be made for less than the fair market value of the land or interest in the land being conveyed, sold or traded, as determined by appraisal, which appraisal shall be conclusive of the fair market value; and la 8018 (0111, WHEREAS, Tax Assessor - Collector of the City of Baytown has made an appraisal of the lands and other valuable con- sideration to be exchanged by the City of Baytown and San Jacinto Methodist Hospital and has determined that the fair market value of the lands and other valuable consideration to be acquired by the City of Baytown is not less than the fair market value of the land to be conveyed to San Jacinto Methodist Hospital by the City of Baytown; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby accepts the appraisal of the Tax Assessor - Collector of the City of Baytown which is attached hereto marked Exhibit "A ". Section 2: That the City Council of the City of Baytown, does hereby authorize the exhange of land owned by the City of Baytown, Texas, described in Exhibit "B," attached hereto, for land owned by San Jacinto Methodist Hospital described in Exhibit "C," attached hereto, and the Mayor and City Clerk are hereby authorized to execute such instruments as are necessary to effect this exchange. This authorization is subject to the City of Baytown retaining a temporary ten - foot utility easement, the center line of which is the City of Baytown's existing water line, until such time as San Jacinto Methodist Hospital dedicates a permanent utility easement and causes the construction of a new water line acceptable to the city. Section 3: That the City Council of the City of Baytown hereby accepts the deed to the property described in Exhibit "C" hereto from San Jacinto Methodist Hospital in consideration for the conveyances of the property described in Exhibit "B". -2- Id `4 i 8019 Section 4: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
