AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, ABANDONING A PORTION OF THE UTILITY EASEMENT
ADJACENT TO LOT 24, BLOCK 16, SECTION II, MILBY DALE
SUBDIVISION, BAYTOWN, HARRIS COUNTY, TEXAS UPON APPROVAL
BY UTILITIES FRANCHISED BY THE CITY; AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SUCH INSTRUMENTS AS ARE
NECESSARY FOR SUCH ABANDONMENT, IF ANY; AND PROVIDING
FOR AN EFFECTIVE DATE HEREOF.
WHEREAS, there presently exists a utility easement
extending along the property line of Lot 24, Block 16,
Section II, Milby Dale Subdivision, Baytown, Harris County,
Texas; and
WHEREAS, the owner of Lot 24, Block 16, Section II,
Milby Dale Subdivision has requested abandonment of a portion
of this easement by the City of Baytown; and
WHEREAS, the provisions of Resolution No. 11 of the
City Council of the City of Baytown dated the 24th day of
January, 1963, have been complied with; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: That, upon receipt of consideration in the
amount of Three Hundred Sixty and No /100 ($360.00) Dollars,
execution of a proper release and hold harmless agreement
and appropriate approval from utilities franchised by the
City, that portion of the utility easement in Lot 24, Block
16, Section II, Milby Dale Subdivision hereinafter described
in Exhibit "A," is hereby abandoned, and the Mayor and City
Clerk are hereby authorized and directed to execute and
attest to any instruments necessary for such abandonment.
Section 2: This ordinance is to become effective from
and after its passage by the City Council of the City of
Baytown on this 22nd day of September 1977.

P' Being a part of a utility easement out of the William Scott
Lower League, A -65, Harris County, Texas, and being that
certain ten foot utility easement as shown on the plat of
Milby Dale, Section Two and being more particularly described
by metes and bounds as follows:
Commencing at the southwest corner of Lot 24, Block 16,
and the northwest corner of Lot 25, Block 16, Milby
Dale, Section Two as shown on said plat;
THENCE, north 210 13' east along the west line of Lot
24 a distance of 20 feet to the Point of Beginning;
THENCE, continuing north 210 13' east along the west
line of Lot 24 a distance of 83.23 feet;
THENCE, north 490 23' 45" east a distance of 21.17
feet;
THENCE, south 210 13' west a distance of 101.89 feet;
THENCE, north 680 41' west a distance of 10 feet to the
Point of Beginning and containing approximately 925.60
square feet more or less.
