Ordinance No. 2,311ORDINANCE NO. 2311 7906 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE BID OF M. S. YOUNG COMPANY, INC. FOR THE RENOVATION OF THE BAYTOWN COMMUNITY BUILDING HEATING AND COOLING SYSTEMS AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF SIXTY -THREE THOUSAND FOUR HUNDRED FIFTY -FOUR AND NO 1100 ($63,454.00) DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS, the City Council of the City of Baytown, Texas, did authorize the administration of the City of Baytown to advertise for bids for the renovation of the Baytown Community Building heating and cooling systems to be received August 30, 1977; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said renovation would be let was published pursuant to provisions of Vernon's Civil Statutes, Article 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 4:00 o'clock p.m., Tuesday, August 30, 1977, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown, Texas, hereby accepts the bid of M. S. Young Company, Inc. according to the plans and specifications set forth by the administration of the City of Baytown on a timetable of 140 calendar days for the sum of Sixty -Three Thousand Four Hundred Fifty -Four and No /100 ($63,454.00) Dollars, and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with M. S. Young Company, Inc. for said renovation, containing the plans, specifications, and requirements of the administration 7907 of the City of Baytown and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes, Article 5160. Section 2: That, pursuant to the provisions of Article 2368a, Section 2a, Vernon's Annotated Texas Statutes, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, subject to the proviso that the original contract price may not be increased by more than twenty -five (25 %) per cent or decreased by more than twenty -five (25%) per cent without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
