Ordinance No. 2,3107897 q -t5 ORDINANCE NO. 2310 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER 26, "STREETS AND SIDEWALKS," ARTICLE II, CONSTRUCTION OF SIDEWALKS, CURBS AND GUTTERS, AND DRIVEWAYS, DIVISION 2, SPECIFICATIONS AND OTHER REGULATIONS, BY REPEALING THIS DIVISION AS PRESENTLY CONSTITUTED AND SUBSTITUTING IN ITS PLACE A NEW DIVISION 2; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section l: That the Code of Ordinances of the City of Baytown, Texas, is hereby amended by amending Chapter 26, "Streets and Sidewalks," Article II, Construction of Sidewalks, Curbs and Gutters, and Driveways, Division 2, Specifications and Other Regulations, by repealing Division 2 as it presently exists and substituting in its place a new Division 2, which shall read as follows, to -wit: Division 2. Specifications and Other Regulations Sec. 26 -30. Standard specification for cement or concrete work. The city hereby adopts and approves as standard speci- fications for cement or concrete sidewalks, driveways, curbs and gutters the following: (a) Basic requirement. Cement or concrete sidewalks, driveways, curbs and gutters shall be built of Port- land cement, fine aggregate and coarse aggregate and reinforced as specified. (b) Concrete body. The concrete shall be composed of standard Portland cement or an approved high, early strength cement, fine aggregate, coarse aggregate and water, mixed and proportioned according to the workability factor method of design, and in accordance with definite specification requirements herein outlined. The concrete shall contain not less than four and one -half (4.5) sacks of cement per cubic yard, and not more than eight gallons of water net, per sack of cement. W The concrete shall be uniform and workable. The amount of coarse aggregate (dry loose volume) shall not be more than 0.85. cubic feet per cubic foot of concrete. The concrete when tested on test specimens cured under field laboratory conditions shall equal or be greater than the following: Compressive strength (Lbs. per sq. inch) 28 days - -3,000 lbs. Flexural strength (Lbs. per sq. inch) 7 days - -650 lbs. (c) Foundation. The foundation shall consist of firm, hard soil from which all vegetable matter and other loose material have been removed. Sidewalks shall be constructed on a sand cushion. 7898 (d) Combined curb and gutter. (1) Thickness. The standard combined curb and gutter shall consist of a curb six (6) inches in thickness and fourteen and three - quarters (14 3/4) inches in height combined with a gutter seven (7) inches in thickness and eighteen (18) inches in width, all built as a monolithic structure. The outer corner of the curb shall be rounded to a three (3) inch radius. (2) Expansion joints. An approved type of commercial premolded expansion joint one inch thick shall be placed through the curb and gutter at the end of all radius returns at street intersections, where meeting existing inlets, or existing curb and gutter, and at intervals of approximately eighty (80) feet on new construction. The joint material shall be cut from one piece of material to conform to the shape of the curb and gutter. (3) Reinforcement. Dowels shall be #4 bars on two foot centers and three #4 bars spaced horizontally. (e) Sidewalks. (1) Thickness. Standard sidewalks shall be composed of not less than four (4) inches of reinforced concrete. (2) Expansion joints. An approved type of commercial premolded expansion joint one -half (A) inch thick shall be placed where two lines of sidewalks intersect, where meeting existing walk, and at intervals of not more than thirty -six (36) feet throughout the entire length of the sidewalk. At all places where sidewalks meet curbs, a one (1) inch approved type of commercial premolded expansion joint shall be provided. All expansion joint material shall extend entirely through the sidewalk, and shall extend the entire width of the sidewalk. -2- (3) Reinforcement. All concrete sidewalks shall be reinforced #6 gauge wire mesh 6" x 6" or #3 bars on 2 foot centers. (4) Width. Sidewalks shall be 4 feet in width unless otherwise specified. (5) Curb ramps. Wheelchair ramps will be provided as required in Section 228 of the Highway Safety Act of 1973. 7899 (6) Construction. All sidewalks shall be constructed in a manner acceptable to the city building inspector and final inspection will not be completed until all work is complete and accepted. (7) Location. Sidewalks will be located at the property line or as directed by the city building inspector. (f) Driveways. (1) Thickness. Standard reinforced concrete drive- ways shall be composed of not less than five (5) inches of concrete on city right of way and four (4) inches of concrete on private property. (2) Width. Maximum width on city right of way shall be eleven (11) feet per automobile stall unless approved in writing by the building inspector. Minimum width on city right of way shall be eight (8) feet. (3) Expansion joints. Concrete drives shall be provided with an expansion joint at sidewalk or curb and at garage or carport slab and at ten (10) foot intervals. (4) Reinforcement. All concrete driveways shall be reinforced using #6 wire mesh 6" x 6" or #3 bars on 2 foot centers. (5) Connections. Where concrete drives connect to curb and gutter sections a minimum radius of two (2) feet shall be provided. Where concrete drives connect to streets with shoulder sections, the concrete pavement shall end at the shoulder and the city will provide an asphalt connection. Also expansion joints will be provided so that a ten (10) foot removable section will be constructed over driveway culverts. (6) Minimum standards. All driveways will conform to FHA minimum standards and all construction and materials must meet the approval of the city building inspector. Sec. 26 -31. Reconstruction of sidewalks on change of line and grade by the city. The city reserves the right, when putting down a permanent street pavement, either by original construction or recon- struction, to change or alter the lines and grades of the -3- N permanent pavement and of the sidewalks, driveways, curbs, and gutters on the street, when in the opinion of the city council such change is necessary for the proper pavement of drainage of the street, and without liability on the part of the city by reason of this change. Sec. 26 -32. Patching. In patching old sidewalks the practice of renewing irreg- ular portions will not be permitted, but the entire section should be renewed. Small pipes may be run across walks in a narrow section and may be neatly cut parallel to the edge of block, and the edges neatly finished with jointing tool. Sec. 26 -33. Mixing mortar on pavements prohibited. It shall be unlawful for any person to mix any lime or other mortar on the surface of any paved street, but a tight board or box most be provided for the purpose. Sec. 26 -34. Protection of new work. After sidewalks, driveways, curbs and gutters have been completed they must be protected from injury by keeping traffic off of them at least five (5) days, and should be sprayed immediately after taking final set with an approved curing compound. Sec. 26 -35. Private drains. It shall be unlawful for any person to construct or main- tain in a public street any drain from private property where the same has been laid for the purpose of taking care of surface drainage from said private property or drainage from roofs of buildings on private property unless such drains shall be laid from the property line to the gutter ditch and shall be constructed entirely of tile or other approved pipe, and shall be laid entirely underneath the surface of the ground, and shall be covered at all points where it crosses under a cement or concrete sidewalk with at least two (2) inches of concrete on top of the pipe and the surface of the sidewalk shall conform in grade to the balance of said walk. All existing drains shall be made to conform to the provisions of the chapter. The downspouts on business houses must empty directly into the gutter or ditch. Sec. 26 -36. General requirements. In general all forms shall be smooth. The work shall be done in a workmanlike manner, giving straight lines where required, true planes and a smooth finish, properly brushed to remove trowel marks and otherwise satisfactory to the building inspector. 7900 When the work is completed all curbs shall have earth thoroughly filled in and tamped against the back. All rubbish, surplus excavated material, forms and other materials shall be removed and the work left in a neat and orderly manner. -4- 7901 In order that sidewalks fulfill the condition of being satisfactory to the building inspector, no obstruction shall project above nor be left below the surface, such as meter boxes, cut -off valves, etc. The practice of leaving the open end of a tile or pipe in the walk to permit access to cut -off valves will not be permitted, but all such must be provided with proper castings around which the walk shall be neatly finished. In case meter box casting cannot be adjusted to proper grade, the city water department shall be notified. Whenever there is room for meter outside of walk it shall not be concreted in, but moved out of the way of the walk. If at any time any of the materials to be used in or for the construction of the work covered by these specifications, do not meet or fulfill all requirements of these specifications, they shall be removed from the site of construction upon being notified of the failure to meet requirements. All defective work either caused by failure of material or workmanship shall be torn out and replaced with new construc- tion to meet the requirements of these specifications and the building inspector. Secs. 26- 37-- 26 -39. Reserved. Section 2: The Typical Sidewalk and Driveway Layouts (See Exhibit "A"), three (3) copies of illustrations of these standard specifications have been and are now on file in the offices of the City Clerk, City Engineer, and Chief Building Inspector of the City of Baytown, are hereby adopted. These specifications shall be controlling in the construction and alteration of sidewalks and driveways. Section 3: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: Savings Clause: If any provision, exception, section, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person -5- W 11 7902 or set of circumstances shall for any reason be held uncon- stitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end, all provisions of this ordinance are declared to be severable. Section 5: Effective Date: This ordinance shall take effect from and after ten (10) days after its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after its passage.
