Ordinance No. 2,3047882 ORDINANCE NO. 2304 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ABANDONING A PORTION OF THE UTILITY EASEMENT ADJACENT TO LOT 8, BLOCK 10, SECTION II, CHAPARRAL VILLAGE SUBDIVISION, BAYTOWN, HARRIS COUNTY, TEXAS UPON APPROVAL BY UTILITIES FRANCHISED BY THE CITY; AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SUCH INSTRUMENTS AS ARE NECESSARY FOR SUCH ABANDONMENT, IF ANY; AND PROVIDING FOR AN EFFECTIVE DATE HEREOF. WHEREAS, there presently exists a utility easement extending along the property line of Lot 8, Block 10, Section II, Chaparral Village Subdivision, Baytown, Harris County, Texas; and WHEREAS, the owner of Lot 8, Block 10, Section II, Chaparral Village Subdivision has requested abandonment of a portion of this easement by the City of Baytown; and WHEREAS, the provisions of Resolution No. 11 of the City Council of the City of Baytown dated the 24th day of January, 1963, have been complied with; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That, upon receipt of consideration in the amount of One Hundred Forty and No /100 ($140.00) Dollars, execution of a proper release and hold harmless agreement and appropriate approval from utilities franchised by the City, that portion of the utility easement in Lot 8, Block 10, Section II, Chaparral Village Subdivision hereinafter described in Exhibit "A," is hereby abandoned, and the Mayor and City Clerk are hereby authorized and directed to execute and attest to any instruments necessary for such abandonment. id LM 883 Section 2: This ordinance is to become effective from and after its passage by the City Council of the City of Baytown on this 25th day of August 1977. McFadden Survey, A -591, Harris County, Texas, and being a part of that certain 16 -foot utility easement as shown on the plat of Chaparral Village Subdivision, Section II, as evidenced by plat filed for record in Volume 167, page 79, of the Map Records of Harris County, Texas, and being more particularly described by metes and bounds as follows: Commencing at the southeast corner of Lot 8, Block 10 of Chaparral Village, Section II; THENCE, north 620 38' 50" west along the south property line a distance of 12.0 feet to the Point of Beginning; THENCE, continuing north 620 38' 50" west along the south property line a distance of 4.0 feet to the point of intersection with the west line of an existing 16- foot utility easement; THENCE, north 270 21' 10" east along said west easement line a distance of 60.0 to the intersection with the north property line; THENCE, south 620 38' 50" east along the north property line a distance of 4.0 feet to a corner; THENCE, south 270 21' 10" west parallel to and 4.0 feet perpendicular from said west easement line a distance of 60.0 feet to the Point of Beginning and containing 240.0 square feet more or less.
