Ordinance No. 2,294X846 ORDINANCE NO. 2294 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING THE CODE OF ORDINANCES BY THE AMENDMENT OF CHAPTER 10, "ELECTIONS," BY THE ADDITION OF A NEW COUNCIL DISTRICT NO. 5 IN ORDER THAT THE NEWLY ANNEXED TERRITORY OF CHAPARRAL VILLAGE, SECTIONS IV AND V MAY BE INCLUDED IN THE PROPER COUNCIL DISTRICT; REPEALING ORDINANCES INCONSISTENT HEREWITH AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. WHEREAS, Section 17(1) of the Charter of the City of Baytown provides that the City Council shall redistrict the City into Council Precincts if the growth of the City justifies; and WHEREAS, it is necessary to include the newly annexed territory of Chaparral Village, Sections IV and V in a Council District; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown is hereby amended by the amendment of Chapter 10, "Elections," by the addition of a new Council District No. 5 which shall read as follows, to -wit: District No. 5 BEGINNING at point of intersection of center line of East Texas Avenue with the center line of State Highway No. 146; THENCE, westerly with the center line of Texas Avenue to center line of North Main Street; THENCE, northerly with the center line of North Main Street to a line which is 200 feet north of and parallel to the north right -of -way line of Massey Tompkins Road; THENCE, easterly with the line which is 200 feet north of and parallel to the north right -of -way line of Massey Tompkins Road to its intersection with the westerly boundary of Tract C -8, J. W. Singleton Survey, A -709; THENCE, northerly with the western boundary of said tract to the northwest corner of said tract; 847 THENCE, easterly with the northern boundary of Tract C- 8, and continuing with the northern boundary of Tract C -9, J. W. Singleton Survey, A -709, to the northeast corner of Tract C -9; THENCE, southerly with the eastern boundary of Tract C- 9 to its intersection with a line which is 200 feet north of and parallel to the north right -of -way line of Massey Tompkins Road; THENCE, easterly with the line which is 200 feet north of and parallel to the north right -of -way line of Massey Tompkins Road to its intersection with the west right -of -way line of Chaparral Drive; THENCE, northward along the west right -of -way line of Chaparral Drive a distance of 592.0 feet to the south line of Chaparral Village Subdivision, Section Three; THENCE, westerly, northerly, easterly, southerly, southerly, westerly, and southerly with the boundaries of Chaparral Village Subdivision, Sections 1, 2, 3, 4, and 5 to the intersection with a line 200 feet north of and parallel to Massey Tompkins Road. THENCE, easterly with a line which is 200 feet north of and parallel to Massey Tompkins Road to the east line of the J. W. Singleton Survey; THENCE, southerly along the east line of the J. W. Singleton Survey to the center line of State Highway No. 146; THENCE, southerly with the center line of State Highway No. 146 to POINT OF BEGINNING. Section 2: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: Savings Clause: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held uncon- stitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this -2- 7848 1W ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: Effective Date: This ordinance shall take effect immediately from and after its passage and the City Clerk is hereby directed to publish the caption of this ordinance at least once in the official newspaper of the City of Baytown.
