Ordinance No. 2,293IQ '"t 1 o��, I g'1 `7 842 A$-t ORDINANCE NO. 2293 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING THE CODE OF ORDINANCES BY THE AMENDMENT OF CHAPTER 10, "ELECTIONS," BY THE ADDITION OF A NEW COUNCIL DISTRICT NO. 4 IN ORDER THAT THE NEWLY ANNEXED TERRITORY OF HOUSTON LIGHTING AND POWER COMPANY'S CEDAR BAYOU PLANT SITE MAY BE INCLUDED IN THE PROPER COUNCIL DISTRICT; REPEALING ORDINANCES INCONSISTENT HEREWITH AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. WHEREAS, Section 17(1) of the Charter of the City of Baytown provides that the City Council shall redistrict the City into Council Precincts if the growth of the City justifies; and WHEREAS, it is necessary to include the newly annexed territory of Houston Lighting and Power Company's Cedar Bayou Plant Site in a Council District; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown is hereby amended by the amendment of Chapter 10, "Elections," by the addition of a new Council District No. 4 which shall read as follows, to -wit: District No. 4 BEGINNING at point of intersection of the center line of State Highway 146 with the center line of East Texas Avenue; THENCE, northerly along the center line of State Highway No. 146 to the east line of the J. W. Singleton Survey; THENCE, northerly with the east line of the J. W. Singleton Survey to a line that is 200 feet from and parallel to the north right -of -way line of Massey Tompkins Road; THENCE, easterly with the line that is 200 feet from and parallel to the north line of Massey Tompkins Road to its intersection with the southwest corner of Kings Bend, Section 2 Subdivisions; Ed 843 THENCE, northeasterly and westerly with the boundaries of Kings Bend, Section 2 and Kings Bend, Section 3 Subdivisions to the east right -of -way line of Raccoon Drive; THENCE, northerly with the east right -of -way line of Raccoon Drive to its intersection with the northern boundary of Whispering Pines, Section 1 Subdivision; THENCE, easterly with the northern boundary and an extension of the northern boundary of Whispering Pines, Section 1 Subdivision to the west bank of Cedar Bayou Stream; THENCE, southerly, easterly, southerly, and westerly with the meanders of the west bank of Cedar Bayou Stream to the extension of the center line of Cary's Bayou; THENCE, northwesterly with the meanders of Cary's Bayou to the northeastern corner of Kings Bend, Section 1 Subdivision; THENCE, southerly with the eastern boundary of Kings Bend, Section 1 Subdivision to a point on the corporate boundary of the city; THENCE, northeasterly, northwesterly, and southeasterly with the corporate boundary to the westerly right -of- way line of State Highway 146; THENCE, northeasterly with the west right -of -way line of State Highway No. 146 to the west shore of Cedar Bayou Stream; THENCE, southerly, following the meanders of the west shore of Cedar Bayou Stream to the south line of a 43 acre tract of land owned by the City of Baytown; THENCE, westerly following the deviations of the south boundary line of the abovementioned 43 acre tract of land to the east right -of -way line of the Cedar Bayou - Barbers Hill Road; THENCE, southerly, following the east boundary line of the Cedar Bayou- Barbers Hill Road to the northwest corner of the Cedar Bayou Methodist Church property; THENCE, in a general easterly direction following the deviations of the north boundary line of the Cedar Bayou Methodist Church to the west shore of Cedar Bayou Stream; THENCE, southerly following the meanders of the west shore of Cedar Bayou Stream to a point of separation of the common line between the west shore of Cedar Bayou Stream and the corporate boundary; THENCE, southerly, easterly, southerly, and westerly along the corporate boundary to another point of inter- section with the west shore of Cedar Bayou Stream; -2- W 844 THENCE, southerly, following the meanders of the west shore of Cedar Bayou Stream to an east projection of the center line of East Texas Avenue; THENCE, westerly, following the center line of an east projection of East Texas Avenue and following the center line of East Texas Avenue to the POINT OF BEGINNING. Section 2: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: Savings Clause: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held uncon- stitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: Effective Date: This ordinance shall take effect immediately from and after its passage and the City Clerk is hereby directed to publish the caption of this ordinance at least once in the official newspaper of the City of Baytown. -3- 7845 INTRODUCED, READ, and PASSED by the affirmative vote of a majority of the City Council of the City of Baytown on this the 25th day of August , 1977.
