ORDINANCE NO. 2282
AN ORDINANCE OF THE CITY COUNCIL
TEXAS, AUTHORIZING THE MAYOR AND
AND ATTEST TO A RELEASE OF LEASE
THE CITY OF BAYTOWN IN THE ABANDI
PLANT SITE IN THE EXXON REFINERY
EFFECTIVE DATE HEREOF.

AND PROVIDING FOR THE
WHEREAS, in 1958 Humble Oil and Refining Company leased
to the City of Baytown a tract of land situated within its
Baytown plant site upon which to locate a sewage treatment
facility for a term of 50 years for the consideration of One
($1.00) Dollar per year; and
WHEREAS, said lease agreement provided the Lessor would
have the right to cancel the lease should the City of Baytown
cease to use the leased premises for the stated purpose and
that the City of Baytown would thereupon remove all improve-
ments which it may have made on the leased premises; and
WHEREAS, the City of Baytown no longer uses the above
mentioned tract as a sewage treatment plant and the improvements
which were situated thereon have been removed; and
WHEREAS, Exxon Company desires a release of the lease
from the City so that possible questions relating to title
to the property can be avoided; and
WHEREAS, the City Council of the City of Baytown deems
that the execution of said release would be in the best
interest of all parties and desires to authorize the execution
of such an instrument; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby authorizes and directs the Mayor and City
Clerk of the City of Baytown to execute and attest to said
release. A copy of said release is attached hereto, marked
Exhibit "A," and made a part hereof for all intents and
purposes.

( Section 2: This ordinance shall take effect from and

after its passage by the City Council of the City of Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of
the City Council of the City of Baytown this 11th day
of August , 1977.

WHEREAS by lease agreement dated September 3, 1958, and recorded in Volume
1101, Page 124, of the Contract Records of Harris County, Texas, Humble Oil &
Refining Company leased to the City of Baytown, Texas, a 2.07 -acre tract or
parcel of land out of the William Scott Upper League, in Harris County, Texas;
and
WHEREAS said instrument also conveyed a 60 -foot -wide right of way and
easement, containing 1.02 acres of land, across adjacent lands in the William
Scott Upper League, for the purposes of ingress to and egress from said leased
premises; and
WHEREAS said instrument also granted an easement for a sewer line over and
across adjacent lands in the William Scott Upper League; and
WHEREAS the City of Baytown no longer utilizes the above premises for the
operation of a sewage disposal plant and is desirous of releasing said lease
and surface rights;
NOW, THEREFORE, the City of Baytown, Texas, acting by and through its
Mayor, does hereby release, remise and quitclaim unto Exxon Corporation,
successor to Humble Oil-& Refining Company, all right, title and interest
acquired by it under and by virtue of the terms of the above - described instru-
ment.
