ORDINANCE NO. 2275
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER
19J, "OFF- STREET PARKING," BY REPEALING THE PROVISIONS
OF THIS CHAPTER AS PRESENTLY CONSTITUTED AND ADOPTING A
NEW CHAPTER 19J, "OFF- STREET PARKING "; PROVIDING FOR A
PENALTY; PROVIDING A REPEALING CLAUSE; CONTAINING A
SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: That the Code of Ordinances of the City of
Baytown, Texas, is hereby amended by repealing the provisions
of Chapter 19A, "Off- Street Parking," as they presently
exist and the same shall cease to have force and effect from
and after the effective date of this ordinance.
Section 2: That the Code of Ordinances of the City of
Baytown is hereby amended by the addition of a new Chapter
19J, "Off- Street Parking," which shall read as follows, to-
wit.

Section 4: Savings Clause: If any provision, exception,
section, subsection, paragraph, sentence, clause or phrase
of this ordinance or the application of same to any person

or set of circumstances shall for any reason be held uncon-
stitutional, void or invalid, such invalidity shall not
affect the validity of the remaining provisions of this
ordinance or their application to other persons or sets of
circumstances and to this end, all provisions of this ordinance
are declared to be severable.
Section 5: Penalty Clause: A person adjudged guilty
of an offense as defined in this chapter shall be punished
by a fine not to exceed Two Hundred ($200) Dollars. Each
day an offense is committed shall constitute a separate
offense.
Section 6: Effective Date: This ordinance shall take
effect from and after ten (10) days from its passage by the
City Council. The City Clerk is hereby directed to give
notice hereof by causing the caption of this ordinance to be
published in the official newspaper of the City of Baytown
at least twice within ten (10) days after the passage of
this ordinance.

OFF- STREET PARKING
Section 19 .1 OFF- STREET PARKING REQUIREIMENTS
There shall be provided hereafter at such time as a building permit is issued
for the erection, alteration or use change of a structure, off - street parking
spaces in accordance with the following minimum requirements:
(1) Bowling alley: Five (5) parking spaces for each lane.
(2) Business or professional office, studio, bank, medical or dental clinic:
Three (3) parking spaces plus one (1) additional parking space for each
two hundred (200) square feet of floor area over five hundred (500).
(3) Community Recreation Center, library, museum or art gallery: Ten (10)
parking spaces plus one (1) additional space for each three hundred (300)
square feet of floor area in excess of two thousand (2,000) square feet.
If an auditorium is included as a part of the building, its floor area
shall be deducted from the total and additional parking provided on the
basis of one (1) space for each four (4) seats that it contains.
(4) Dance hall, assembly or exhibition hall without fixed seats: One parking
space for each one hundred (100) square feet of floor area used thereof.
(5) Townhouses, two - family and multi- family dwellings: Two and one quarter
spaces per dwelling unit. Guest parking is to be provided within three
hundred (300) feet of each dwelling unit.
(6) Fraternity, sorority or dormitory: One parking space for each three (3)
beds.
(7) Furniture or applicance store, hardware store, wholesale establishments,
machinery or equipment sales and service, clothing or shoe repair or
service shop: Two (2) parking spaces plus one (1) additional parking
space for each three hundred (300) square feet of floor area over one
thousand (1,000).
(8) Hospital: Four (4) parking spaces plus one (1) additional parking space
for each four (4) beds.
(9) Hotel: One (1) parking space for each two (2) sleeping rooms or suites
plus one (1) space for each ti•:o hundred (200) square feet of commercial
floor area contained therein.
(10) Industrial Plants: The number of parking spaces required to accommodate
all plant employees and construction forces on any single shift.

(11) Mortuary or funeral home: One (1) parking space for each fifty (50)
square feet of floor space in slumber rooms, parlors or individual funeral
.service rooms.
(12) Motor- vehicle salesrooms and used car lots: One (1) parking space for
each eight hundred (800) square feet of sales floor or lot area.
(13) Private club, lodge, country club or golf club: One (1) parking space
for each one hundred fifty (150) square feet of floor area or for every
five (5) members, whichever is greater.
(14) Retail store or personal service establishment except as otherwise spec
ified herein: One (1) parking space for each two hundred (200) square
feet of retail sales.or floor area.
(15) Restauarant, nightclub, cafe or similar recreation or.ar�iusement establish -
ment:-, One (1) parking space for each one hundred (100) square feet of
floor area.
(16) Rooming or boarding house: One (1) parking space for each sleeping room.
(17) Sanitarium, convalescent home, home for the aged or similar institution:
One (1) parking space for each (6) beds.
(18) School, elementary: One (1) parking space for each ten (10) seats in
the auditorium or main assembly room, or one (1) space for each class-
room, whichever is greater.
(19) School, secondary, and college: One (1) parking space for each eight
(8) seats in the main auditorium or three (3) spaces for each classroom,
whichever is greater.
(20) Church, theater, auditorium (except school), sports arena, stadium, or
gymnasium: One (1) parking space for each (4) seats or bench seating
spaces.
(21) Tourist home; cabin or motel: One (1) parking space for each sleeping
room or suite.
Section 1911.2 RULES FOR COMPUTING NUMBER OF PARKING SPACES.
In computing the number of parking spaces required for each of the above uses
the following rules shall govern:
(1) "Floor area" shall mean the foundation area of the specified use.
(2) 4Yhere fractional spaces result, the parking spaces required shall be con-
strued to be the nearest whole number.
(3) The parking space requirement for a use not specifically mentioned herein
shall be the same as required for a use of a similar nature.
(4) In the case of mixed used, the parking spaces required shall equal the
sum of the requirements of the various uses computed separately.

Section 192.3 CONSTRUCTION OR USE CHANGES
(1) 11henever a building or use is constructed or charged after the effective
P"', ' date of this Chapter by enlarging the floor area, number of employees,
number of dwelling units, seating capacity or otherwise, to create a re-
quirement for an increase in the number of parking spaces, such spaces
shall be provided on the basis of the enlargement or the change in use.
Section 192.4 LOCATION OF PARKING SPACES
All parking spaces required herein shall be located on the same lot with the
building or use served, except as follows:
(1) Where an increase in the number of spaces is required by a change or
enlargement of use or where such spaces are provided collectively or used
jointly by two (2) or more buildings or establishments, the required
spaces may be located not to exceed three hundred (300) feet from an in-
stitutional building served and not to exceed five hundred (500) feet
from any other non - residential building served.
(2) No more than fifty (50n) percent of the parking spaces required for thea-
tens, bowling lanes, dance halls, nightclubs or cafes may be provided
and used jointly by similar uses not normally open, used or operated
during the same hours as those listed; provided, however, that written
agreement thereto is properly executed and filed as specified below.
(3) Not more than eighty (80) percent of the parking spaces required for a
church or school auditorium may be provided and used jointly by similar
uses not normally open, used or operated during the same hours as those
listed; provided, however, that written agreement thereto is properly
executed and filed as specified below.
(4) In any case where the required parking spaces are not located on the same
lot with the building or use served, or where such spaces are collectively
or jointly provided and used, a written agreement thereby assuring their
intention for such purposes, shall be properly drawn and executed by the
parties concerned, approved as to form by the City Attorney and shall be
filed with the application for a building permit.
Section 192.5 MINIMUM DIMENSIONS FOR OFF- STREET PARKING
(1) Ninety (90) Degree Angle Parking: Each parking space shall be not less
than nine (9) feet wide nor less than eighteen (1S) feet in length.
Maneuvering space shall be in addition to parking space and shall be not
less than twenty- three(23) feet perpendicular in width.

(2) Sixty (60) Degree Angle Parking

Each parking space shall be not less
than nine (9) feet wide perpendicular to the parking angle nor less
than seventeen (17) feet in length when measured at. thc: ztptrronAiatc
angles. Maneuvering space shall be in addition to
parking space and shall be not less than twenty (20) feet in width.

(3) Forty -Five (45) Degree Angle Parking: Each parking space shall be not
less than nine (9) feet wide perpendicular to the parking angle nor
less than nineteen(19) feet in length when measured at the appropriate angles.
Maneuvering space shall be in addition
to, parking space and shall be not less than eleven (11) feet in width.

(4) {there off - street parking facilities are provided in excess of the minimum
amounts herein specified, or when off - street parking facilities are pro-
vided but not required by this Chapter, said off- street parking facilities
shall comply with the minimum dimensions for parking and maneuvering space
herein specified.
Section 19'h.6 DESIGN STANDARDS
Geometric design standards for driveways and off - street parking stalls are
set forth in Appendix 1 to this Ordinance. Curb cuts shall conform to Standards
established in the Engineering Department. Permits for all curb cuts will
be issued by the Chief Building Inspector.
Section 1911.7 ADMINISTRATIVE PROCEDURE
The administration and inspection requirements of this chapter shall be the
responsibility of the Chief Building Inspector. He shall determine that the

provisions of this chaptt,:: complied with prior to the approval or the issuance
of a building permit.
Section 19.8 GRANTING OF EXCEPTIONS
The Chief Building Inspector is hereby granted the authority to issue a building
permit where there are minor discrepancies with regard to the requirements
established in this chapter, where it is determined that the literal applica-
tion of such provisions would constitute an undue hardship with regard to the
applicant's particular circumstances, and would not be essential in accomplish-
ing the objectives of this chapter. Should the applicant be dissatisfied with
the decision of the Chief Building Inspector with regard to a requested excep-
tion, he shall be entitled to appeal such decision to the City Council.

Section 19h.9 AREAS EXCLUDED FROM APPLICATION Or CHAPTER

to certain central business district areas as depicted on the maps set forth
in Appendix 2 to this Code of Ordinances. All private property shown in the
shaped portions on such maps is hereby excluded from the requirements of this
chapter.
