ORDINANCE NO. 2264
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, ABANDONING A PORTION OF THE UTILITY EASEMENT
ADJACENT TO LOT 2, BLOCK 5, SECTION 1, ALLENBROOK
SUBDIVISION, BAYTOWN, HARRIS COUNTY, TEXAS; AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE SUCH INSTRUMENTS AS
ARE NECESSARY FOR SUCH ABANDONMENT, IF ANY; AND PROVIDING
FOR AN EFFECTIVE DATE HEREOF.
WHEREAS, there presently exists a utility easement
extending along the property line of Lot 2, Block 5, Section
1, Allenbrook Subdivision, Baytown, Harris County, Texas;
and
WHEREAS, the owner of Lot 2, Block 5, Section 1, Allen-
brook Subdivision has requested abandonment of a portion of
this easement by the City of Baytown; and
WHEREAS, the provisions of Resolution No. 11 of the
City Council of the City of Baytown dated the 24th day of
January, 1963, have been complied with; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: That, upon receipt of consideration in the
amount of One Hundred ($100) Dollars and execution of a
proper release and hold harmless agreement, that portion of
the utility easement in Lot 2, Block 5, Section 1, Allenbrook
Subdivision hereinafter described in Exhibit "A," is hereby
abandoned, and the Mayor and City Clerk are hereby authorized
and directed to execute and attest to any instruments nec-
essary for such abandonment.
Section 2: This ordinance is to become effective from
and after its passage by the City Council of the City of
Baytown on this 14th day of July 1977.

Being a utility easement out of the Harvey Whiting Survey,
A -840, Harris County, Texas, and being a part of that certain
16 foot utility easement as shown on the plat of Allenbrook
Subdivision, Section I, as evidenced by plat filed for
record in Volume 219 at page 95 of the Map of Records of
Harris County, Texas, and being more particularly described
by metes and bounds as follows:
Commencing at the Northwest corner of Lot 2, Block 5,
of Allenbrook Subdivision, Section One;
Thence, N 870 56' 58" W along the north property line
of Lot 2 a distance of 16.0 feet to the point of inter-
section of said north property line and the east line
of a 16 foot utility easement;
Thence, S 020 03' 02" W along the east line of said 16
foot utility easement a distance of 5.0 feet to the
Point of Beginning;
Thence, continuing S 020 03' 02" W along the east line
of said 16 foot utility easement a distance of 26.0
feet to a corner;
Thence, S 870 56' 58" E a distance of 2.8 feet to a
corner;
Thence, N 020 03' 02" E parallel to the east line of
said 16 foot utility easement a distance of 26.0 feet;
Thence, N 870 56' 58" W a distance of 2.8 feet to the
Point of Beginning, enclosing 72.80 square feet more or
less.
