Ordinance No. 2,2640 7716 ORDINANCE NO. 2264 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ABANDONING A PORTION OF THE UTILITY EASEMENT ADJACENT TO LOT 2, BLOCK 5, SECTION 1, ALLENBROOK SUBDIVISION, BAYTOWN, HARRIS COUNTY, TEXAS; AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SUCH INSTRUMENTS AS ARE NECESSARY FOR SUCH ABANDONMENT, IF ANY; AND PROVIDING FOR AN EFFECTIVE DATE HEREOF. WHEREAS, there presently exists a utility easement extending along the property line of Lot 2, Block 5, Section 1, Allenbrook Subdivision, Baytown, Harris County, Texas; and WHEREAS, the owner of Lot 2, Block 5, Section 1, Allen- brook Subdivision has requested abandonment of a portion of this easement by the City of Baytown; and WHEREAS, the provisions of Resolution No. 11 of the City Council of the City of Baytown dated the 24th day of January, 1963, have been complied with; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That, upon receipt of consideration in the amount of One Hundred ($100) Dollars and execution of a proper release and hold harmless agreement, that portion of the utility easement in Lot 2, Block 5, Section 1, Allenbrook Subdivision hereinafter described in Exhibit "A," is hereby abandoned, and the Mayor and City Clerk are hereby authorized and directed to execute and attest to any instruments nec- essary for such abandonment.
