Ordinance No. 2,2637713 ORDINANCE NO. 2263 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DESIGNATING CEDAR COVE CANAL AS A NO WAKE ZONE; REPEALING ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR A PENALTY FOR THE VIOLATION THEREOF; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown is hereby amended by the amendment of Chapter 17, "Miscellaneous Provisions and Offenses," by the addition of a new Section 17 -21.1, which shall read as follows: Sec. 17 -21.1 Designation of no wake zones. Pursuant to the provisions of Section 17 -21 of the Code of Ordinances, the following described body of water is hereby declared to be a no wake zone: (a) Cedar Cove Canal, being that body of water beginning at the internal corner on the south property line of Cedar Cove Subdivision, approximately 280 feet east of Roseland Park Drive to the POINT OF BEGINNING. THENCE, S 700 59' 52" E along the southern property line of Cedar Cove a distance of 692.99 feet to a point; THENCE, southwesterly along the west bank of Cedar Bayou a distance of 58 feet more or less to a point for corner, said point being in the southerly easement line of a 60 foot canal (now called "Cedar Cove Canal "); THENCE, N 700 59' 52" W a distance of 692.99 feet to a point for corner in the easterly property line of Cedar Cove Subdivision; THENCE, N 190 00' 08" E a distance of 58 feet along said property line to the POINT OF BEGINNING. Section 2: That the Director of Planning and Traffic is authorized and directed to cause the proper signs to be posted as designated above. 7714 Section 3: Any person violating the provisions of this ordinance shall be punished by a fine of not more than Two Hundred ($200) Dollars, and each violation shall constitute a separate offense. Section 4: That a copy of these regulations and all amendments thereto shall be summarily filed with the Texas Parks & Wildlife Department. Section 5: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 6: Savings Clause: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to the end all provisions of this ordinance are declared to be severable. Section 7: Effective Date: This ordinance shall take effect from and after ten (10) days from its passage by the City Council.
