Ordinance No. 2,260I ORDINANCE NO. 2260 AN ORDINANCE OF THE CITY COUNCIL TEXAS, AUTHORIZING AND DIRECTING CITY CLERK TO EXECUTE AND ATTEST RETIRED SENIOR VOLUNTEER PROGRAM RECRUITMENT, AND COORDINATION OF COMMUNITY SERVICE. 7694 OF THE CITY OF BAYTOWN, THE CITY MANAGER AND TO A CONTRACT WITH THE FOR THE REGISTRATION, SENIOR VOLUNTEER BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby approves the contract with the Retired Senior Volunteer Program and authorizes and directs the City Manager and City Clerk of the City of Baytown to execute and attest to said contract. A copy of said contract is attached hereto, marked Exhibit "A," and made a part hereof for all intents and purposes. Section 2: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown. HALL, City Clerk APPROVED: NEE RI A SON, City Attorn y V 1 , 7695 EXHIBIT "All 7696 THE STATE OF TEXAS ) COUNTY OF HARRIS ) THIS AGREEMENT, made and entered into by and between the CITY OF BAYTOWN, a municipal corporation, here- inafter called "City," and the Retired Senior Volunteer Program, hereinafter called the "Program Applicant." WITNESSETH: WHEREAS, the Retired Senior Volunteer Program has been organized to strengthen and supplement efforts to meet a broad range of human, social, and environmental needs by encouraging and enabling constructive volunteer service in agencies, institutions and situations where the application of human talent and dedication may help to meet such ends; and WHEREAS, the City Council of the City of Baytown has determined it is in the public interest that such a program to help retired persons avail themselves of oppor- tunities for volunteer service in the community is in the public interest; NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That in consideration of the mutual convenants, agreements and benefits to both parties, it is agreed as follows: I. The Program Applicant, as independent contractor, agrees, in accordance with the terms of their project application (attached hereto and made a part hereof for all intents and purposes) to register non - profit and public agencies and institutions in the City of Baytown that are in need of volunteers, to recruit men and women over sixty to act as 7697 volunteers, to support and publicize these Senior Volunteers, and to do all other acts necessary for the successful operation of this civic enterprise. II. This agreement is to cover services to be rendered from July 18, 1977, to September 30, 1977. III. The City agrees to pay to Retired Senior Volunteer Program the sum of Nine Hundred Twenty -One and 95/100 ($921.95) Dollars for service to be rendered in the development, organization, supervision, and management of this program, but in no event will the City pay more. IV. In performance of the services agreed to herein, the Program Applicant agrees to observe and strictly comply with, all the terms, conditions, rules and regulations of all applicable federal, state, and city statutes. V. It is expressly agreed and understood by all parties hereto that the Program Applicant is an independent contractor in its relationship to the City of Baytown. Nothing herein contained at any time or in any manner shall be construed to effect an agreement of partnership or joining venture or render any party hereto the employer or master of any other party and /or its employees, agents or representatives. VI. The Program Applicant agrees to indemnify, and does hereby indemnify, hold harmless and defend, the City of Baytown, its agents, servants, or employees, from and against -2- 7698 any and all claims for damages or injuries to persons or property, whether real or asserted, arising out of or incident to the operation of this program. Program operation began in Harris County in June of 1972. During the spring of 1976 an RSVP Advisory Council was formed in the Baytown area. Following the recommendation of its mem- bers, a fulltime RSVP Field Coordinator was hired in October 1976. The responsibilities of this individual include: - the registration of non - profit agencies and institutions in the Baytown community which are in need of volunteers - the recruitment of men and women over sixty to act as volunteers - support and recognition of these Senior Volunteers Funding for this staff position and other and office space was to be shared between ACTION and the local community. To date received: ACTION Community Resources - Exxon Company, U.S.A. Exxon Chemical Company Lions Club - Wooster Baytown Kiwanis Lee College local expenses such as telephone the Federal sponsoring agency: the following support has been $3,487 700 400 250 125 2,560 - In -kind contribution of office space, equipment, and supplies In June 1977 the position of Field Coordinator was changed to a parttime one with the area of responsibility limited to the city of Baytown. It is the intention of the Advisory Council to continue this position on a part - time basis throughout the new budget period October 1, 1977 - September 30, 1978. Expenses for this period should be available through ACTION, new state funding, and other community sources. The request to the City of Baytown, therefore, is for $921.95 which will cover the salary, fringe benefits, and transportation expenses of the part - time Field Coordinator through September 30, 1977. This will make possible a continuance of program operation without interruption until the beginning of the new budget year in October of this year. 7701.
