ORDINANCE NO. 2243
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS;
ACCEPTING THE BID OF FRYMIRE ENGINEERING FOR THE EMERGENCY
REPAIR OF THE AIR CONDITIONING UNIT AT'THE BAYTOWN
COMMUNITY CENTER; AUTHORIZING THE PAYMENT OF THE SUM OF
THREE THOUSAND NINE HUNDRED FIFTY AND NO /100 ($3,950.00)
DOLLARS WITH REGARD TO SUCH ACCEPTANCE, AND PROVIDING
FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, due to unforseen damages to the air conditioner
coils in the central air unit at the Baytown Community
Center, said unit is presently out of working order; and
WHEREAS, the Baytown Parks and Recreation Department's
summer activities are beginning, and the Community Center is
scheduled for more intensive use; and
WHEREAS, Art. 2368a V.T.C.S. provides in the case of
unforseen damage to public property, machinery or equipment,
the requirement of competitive bids is not applicable; and
WHEREAS, the City Administration has taken quotations
for the repair of the unit; and
WHEREAS, considering the above, the City Council of the
City of Baytown deems that an emergency situation exists and
wishes to proceed with the repair of the air conditioner
without the necessity of publishing notice and taking formal
bids; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that due to unforseen damages to the
air conditioning unit at the Baytown Community Center an emergency
situation exists.

Section 2: That the bid of Frymire Engineering to
repair the air conditioning unit is hereby accepted, and the
payment of the sum of Three Thousand Nine Hundred Fifty and
No /100 ($3,950.00) Dollars is hereby authorized upon completion
and acceptance of the work.
Section 3: This ordinance shall take effect from and
after its passage by the City Council of the City of Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of
the City Council on this 26th day of May , 1977.
