ORDINANCE NO. 2234
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, ESTABLISHING MINIMUM BUILDING STANDARDS GOVERNING
THE CONSTRUCTION, ALTERATION, EQUIPMENT, AND REMOVAL OF
BUILDINGS AND STRUCTURES FOR INDUSTRIAL AND COMMERCIAL
CONSTRUCTION WITHIN THE CITY LIMITS OF THE CITY OF
BAYTOWN; REPEALING ORDINANCES INCONSISTENT HEREWITH;
CONTAINING A SAVINGS CLAUSE; PROVIDING A PENALTY AND
EFFECTIVE DATE HEREOF.
WHEREAS, the Southern Building Code Congress has promulgated
a certain work known as the Standard Building Code, 1976
Edition; and
WHEREAS, the City Council of the City of Baytown believes
that such rules and regulations would be advantageous to
Baytown; and
WHEREAS, the laws of the State of Texas provide that
such standards may be adopted by reference; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: Except as hereinafter provided, the
Standard Building Code by the Southern Building Code Congress,
1976 Edition, and all amendments thereto, heretofore or
hereafter adopted, of which not less than three (3) copies
are to be on file in the office of the City Clerk of the
City of Baytown and the same is hereby adopted and incor-
porated as fully as if set forth at length herein, and from
the date on which this ordinance shall take effect, the
provisions therein shall be controlling in the construction,
alteration, equipment, and removal of buildings and structures
for industrial and commercial construction within the City
limits of the City of Baytown.
Section 2: Section 107.4, Schedule of Permit Fees, shall
not be applicable. Any person, firm or corporation applying to

the City of Baytown for a building permit, shall pay to the
city, prior to the issuance of said permit, a building
permit fee based on the following schedule:
Improvements costing:
(a) $1.00 to $1,000.00 ------- - - - - -- $10.00
(b) Per each additional $1,000.00 of
improvements--------------- - - - - -$ 1.00
Section 3: Section 304, Exceptions to Restrictions in
Fire District, shall be amended by the addition of the
following exception:
11. The City Council of the City of Baytown shall have
the authority to grant further exceptions in the second fire
district on a temporary basis, for a period not to exceed
six (6) months, for temporary buildings to be utilized during
the construction or remodeling of permanent structures.
Section 4: Section 411, Residential Occupancy, shall
be amended by the amendment of subsection 411.1(b) by deleting
"dwellings" from the scope of said section.
Section 5: Section 2204, Moving of Buildings, shall
not be applicable.
Section 6: Nothing in this ordinance or in the code
hereby adopted shall be construed to affect any suit or
proceedings now pending in any court, or any rights acquired
or liability incurred, nor any cause or causes of action
accrued, or existing, under any act or ordinance repealed
hereby. Nor shall any right or remedy of any character be
lost, impaired, or affected by this ordinance.
Section 7: If any provision, exception, section,
subsection, paragraph, sentence, clause or phrase of this
ordinance or the application of same to any person or set of
circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity
of the remaining provisions of this ordinance or their
application to other persons or sets of circumstances and to
this end all provisions of this ordinance are declared to be
severable.

Section 8: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are also
hereby repealed; provided, however, that such repeal shall
be only to the extent of such inconsistency and in all other
respects this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered by this
ordinance.
Section 9: Any person who shall violate any provision
or provisions of this ordinance shall be guilty of a misdemeanor
and, upon conviction, shall be punished by a fine of not
more than Two Hundred ($200.00) Dollars. Each day of the
continuance of such violation shall be considered a separate
offense.
Section 10: This ordinance shall take effect from and
after ten (10) days after its passage by the City Council.
The City Clerk is hereby directed to give notice hereof by
causing the caption of this ordinance to be published in the
official newspaper of the City of Baytown at least twice
within ten (10) days after its passage.
INTRODUCED, READ, and PASSED by the affirmative vote of
a majority of the City Council of the City of Baytown, this
