Ordinance No. 2,2187498 ORDINANCE NO. 2218 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE BID OF ABLE SERVICES, INC. FOR THE CONSTRUCTION OF THE 1977 STREET IMPROVEMENT PROGRAM AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF THREE HUNDRED TEN THOUSAND THREE HUNDRED NINETY -FIVE AND N01100 ($310,395.00) DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS, the City Council of the City of Baytown, Texas, did authorize the City Engineer of the City of Baytown to advertise for bids for the construction of the 1977 Street Improvement Program to be received April 19, 1977; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of Vernon's Civil Statutes, Article 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 2:00 o'clock p.m., Tuesday, April 19, 1977, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN : Section 1: That the City Council of the City of Baytown, Texas, hereby accepts the bid of Able Services, Inc., according to the plans and specifications set forth by the City Engineer on a construction timetable of 110 working days for the sum of Three Hundred Ten Thousand Three Hundred Ninety -Five and No /100 ($310,395.00) Dollars, and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Able Service, Inc. for the construction of the following streets under the 1977 Street Improvement Program: Bayless, Baylor, North Burnett, North Eighth, West Francis, Gresham, North Jones, Illinois, King, 7499 Morrell, Newman, State, and Schilling; containing the plans, specifications, and requirements of the City Engineer and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes, Article 5160. Section 2: That, pursuant to the provisions of Article 2368a, Section 2a, Vernon's Annotated Texas Statutes, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, subject to the proviso that the original contract price may not be increased by more than twenty -five (25 %) percent or decreased by more than twenty -five (25 %) percent without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
