ORDINANCE NO. 2174
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, RESCINDING ORDINANCE NO. 2146 AWARDING THE BID
FOR THE SANDBLASTING AND PAINTING OF A GROUND STORAGE
WATER TANK LOCATED ON BAYWAY DRIVE NEAR BAKER ROAD TO
TEXAS CRANE CONSULTANTS, INC. AND RE- AWARDING SAID BID
TO COASTAL TANK LINING COMPANY FOR THE SUM OF THIRTEEN
THOUSAND EIGHT HUNDRED NINETY -FIVE AND N01100 ($13,895.00)
DOLLARS; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of Baytown,
Texas, authorized the City Engineer to advertise for bids
for the sandblasting and painting of a ground storage water
tank located on Bayway Drive near Baker Road to be received
December 14, 1976; and
WHEREAS, the plans and specifications for the bid
required that the successful bidder furnish performance and
payment bonds executed by good and sufficient sureties
satisfactory to the City in the amount of the contract
price; and
WHEREAS, the City Council by Ordinance No. 2146 awarded
said bid to the low bidder, Texas Crane Consultants, Inc.,
according to the plans and specifications set forth by the
City Engineer on a construction timetable of 45 working days
for the sum of Twelve Thousand Eight Hundred and No /100
($12,800.00) Dollars; and
WHEREAS, Texas Crane Consultants, Inc. has advised the
City that it is unable to furnish the required performance
and payment bonds; and
WHEREAS, the City Council deems that the contract has
been breached because of Texas Crane Consultants, Inc.'s
inability to provide performance and payment bonds as required
by the plans and specifications and desires to rescind its

previous action awarding said bid to Texas Crane Consultants,
Inc. and City Council further desires to re -award said bid
to Coastal Tank Lining Company, the second low bidder; NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, finds the matters and facts recited in the above
preamble of this ordinance are found to be true and correct.
Section 2: That Ordinance No. 2146 is hereby repealed
so that previous action awarding City of Baytown Contract
No. 76 -30, to Texas Crane Consultants, Inc. be and is hereby
rescinded.
Section 3: That the City Council hereby re- awards the
bid for the sandblasting and painting of a ground storage
water tank located on Bayway Drive near Baker Road to the
second low bidder, Coastal Tank Lining Company, according to
the plans and specifications set forth by the City Engineer
for the sum of Thirteen Thousand Eight Hundred Ninety -Five
and No /100 ($13,895.00) Dollars, and the Mayor and City
Clerk of the City of Baytown are hereby authorized and
directed to execute and attest to a contract with Coastal
Tank Lining Company for the sandblasting and painting of
said tank.
Section 4: That, pursuant to the provisions of Article
2368a, Section 2a, Vernon's Annotated Texas Statutes, the
City Manager is hereby granted general authority to approve
any change order involving a decrease or an increase in
costs of Five Thousand and No /100 ($5,000.00) Dollars or
less, subject to the proviso that the original contract

price may not be increased by more than twenty -five (25%)
per cent or decreased by more than twenty -five (25 %) per
cent without the consent of the contractor to such decrease.
Section 5: That this ordinance shall take effect from
and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of
