ORDINANCE NO. 2157
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING AND DIRECTING THE MAYOR AND CITY
CLERK OF THE CITY OF BAYTOWN TO EXECUTE AND ATTEST TO A
CONTRACT WITH HARRIS COUNTY PROVIDING FOR REHABILITATION
WORK IN CERTAIN AREAS OF THE CITY UNDER COMMUNITY
DEVELOPMENT BLOCK GRANT NO. B- 77 -UC -48 -0002 AND PROVIDING
FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby approves the contract providing for joint
participation between the City of Baytown and Harris County
for rehabilitation work in certain areas of the City under
Community Development Block Grant No. B- 77 -UC -48 -0002 and
authorizes and directs the Mayor and City Clerk of the City
of Baytown to execute and attest to such contract. A copy
of said contract is attached hereto, marked Exhibit "A," and
made a part hereof for all intents and purposes.
Section 2: This ordinance shall take effect from and
after its passage by the City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of
the City Council of the City of Baytown this 13th day
of January 1977.

OOOPERATION AGREEMEOr BETWEEN HARRIS COUNTY
_ AND CITY OF BAYTOWN
THE STATE OF TEXAS )
COUNTY OF HARRIS )
THIS AGREEMENT, made and entered into by and between Harris County,
a body corporate and politic under the laws of the State of Texas, hereinafter
referred to as the "County,' and the City of Baytown, a municipal corpora-
tion under the laws of the State of Texas, hereinafter referred to as the
''C ity, "
W I T HE S S E T H:
WHERF,AS, the County desires to include the population of the City
as a portion of the population of the County in the County's application to the
U. S. Department of Housing and Urban Development for the third year funding
request for a Grant known as Community Development Block Grant No. B- 77 -UC-
48 -0002, hereinafter sometimes referred to as the "Grant;" and
WHEREAS, the City desires that its population be so included in said
Application; and
WHEREAS, the County desires to undertake within the City or to assist
in the undertaking within the City of essential activities such as community
renewal and lower income housing activities pursuant to said Grant; and
WHEREAS, the City desires that the County undertake or assist in the
undertaking of said essential activities; and
WHEREAS, the County and the City desire to cooperate in such under-
taking; and
WHEREAS, the Texas Legislature has enacted the "Texas Community
Development Act of 1975," codified in Tex. Rev. Civ. Stat. Ann. art. 12691 -4
which provides, in part, for the authorization of cities to implement a com-
munity development program; and
WHEREAS, the Texas Legislature has further enacted "The Interlocal
Cooperation Act," codified at Tex. Rev. Civ. Stat. Ann. art. 4413 (32c), which
provides, in part, that the County may contract with the City to perform govern-
mental functions and services for the City;

NOW, THEREFORE, KNCYR ALL I1EN BY THESE PRESENTS: That the County and
the City, in consideration of the mutual covenants and agreements herein con-
tained, do mutually agree as follows:
I.
The City agrees to allow the inclusion of its population with that
of the County, in the above mentioned Application of the County.
II.
The City agrees to allow the U. S. Department of Housing and Urban
Development to use the City's population and other necessary demographic charac-
teristics in the determination of whether the County will qualify as an "urban
county" as defined in the Housing and Community Development Act of 1974 and the
rules and regulations promulgated pursuant thereto.
III.
The City authorizes the County to administer within the City such
projects and programs as may be approved by the U. S. Department of Housing
and Urban Development for payment with Grant funds.
IV.
It is understood and agreed that under the terms and provisions of
the Grant and Grant Application the County is to receive .fifteen (15 %) per-
cent of the funds received from the U. S. Department of Housing and Urban
Development for the administration thereof. Furthermore, it is understood
and agreed that the County contemplates entering, and /or has entered, into
more than one agreement under the said Grant, and if the funds received by
the County from the U. S. Department of Housing and Urban Development are
received in a lump sum, or if the funds are not classified as to contracting
parties and purposes, then and in that event and subject to any requirements
of federal laws, regulations and the Grant, the County's division and classi-
fication of the funds among the contracting parties and purposes contemplated
by the Application and Grant shall be final and conclusive between the City
and the County. However, if the funds received by the County from the U. S.
Department of Housing and Urban Development are classified as to contracting
parties and purposes, then and in that event, the U. S. Depart -ent of Housing

and Urban Development's division and classification of the funds, among the
contracting parties and purposes contemplated by the Application and Grant
shall be final and conclusive between the City and the County.
V.
This agreement shall remain in full force and effect for the entire
third year funding period of said Grant and Application.

In performance of this agreement, the City shall observe and comply
with all applicable Federal, State, County and City statutes, ordinances,
rules and regulations and with the terms of said Grant and Application.

referred to and made a part hereof for all purposes as though fully set out
herein
