Ordinance No. 2,1467194 ORDINANCE NO. 2146 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE BID OF TEXAS CRANE CONSULTANTS, INC. FOR THE SANDBLASTING AND PAINTING OF A GROUND STORAGE WATER TANK LOCATED ON BAYWAY DRIVE NEAR BAKER ROAD AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF TWELVE THOUSAND EIGHT HUNDRED AND N01100 ($12,800.00) DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS, the City Council of the City of Baytown, Texas, did authorize Ken Powers, City Engineer for the City of Baytown, to advertise for bids for the sandblasting and painting of a ground storage water tank located on Bayway Drive near Baker Road to be received December 14, 1976; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said sandblasting and painting would be let was published pursuant to provisions of Vernon's Civil Statutes, Article 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 10:00 a.m., Tuesday, December 14, 1976, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown, Texas, hereby accepts the bid of Texas Crane Consultants, Inc. according to the plans and specifications set forth by the City Engineer on a construction timetable of 45 working days for the sum of Twelve Thousand Eight Hundred and No /100 ($12,800.00) Dollars, and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Texas Crane Consultants, Inc. for the sandblasting and painting of said water tank, containing 7195 the plans, specifications, and requirements of the City Engineer and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes, Article 5160. Section 2: That, pursuant to the provisions of Article 2368a, Section 2a, Vernon's Annotated Texas Statutes, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, subject to the proviso that the original contract price may not be increased by more than twenty -five (25 %) per cent or decreased by more than twenty -five (25 %) per cent without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
